AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED: "FY'2004 MIAMI-DADE COUNTY
SURTAX FUND" TO PROVIDE MULTI -FAMILY HOUSING REHABILITATION FOR
PROPERTIES WITH EXPIRING CONTRACTS FOR SECTION 8 PROJECT
BASED HOUSING UNITS TO INCREASE AVAILABILITY OF DECENT
AFFORDABLE HOMEOWNERSHIP AND RENTAL HOUSING UNITS, AND
APPROPRIATING FUNDS, IN THE AMOUNT OF $1,000,000, TO SAID FUND,
CONSISTING OF A GRANT RECEIVED FROM MIAMI-DADE COUNTY;
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND TO
EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, FOR IMPLEMENTATION OF THE GRANT; CONTAINING A
REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on December 4, 2003, the Miami -Dade Board of County Commissioners
approved the FY 2003-2007 Consolidated Plan and the FY 2004 Action Plan, including an
allocation of FY'2004 Surtax funds in the amount of $1,000,000 to the City of Miami;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Fund is established and resources are
appropriated as described herein:
FUND TITLE: FY' 2004 Miami -Dade County Surtax Fund
RESOURCES: FY' 2004 Surtax Funds $1,000,000
APPROPRIATIONS: $1,000,000
Section 3. This appropriation is contingent upon the receipt of the grant from Miami -Dade
Office of Community and Economic Development and the City Manager's acceptance thereof.
Section 4. The City Manager is authorized{1} to accept the grant from Miami -Dade County to
provide multi -family housing rehabilitation for properties with expiring contracts for Section 8
project based housing unites to increase availability of decent affordable Homeownership and

rental housing units.
Section 5. The City Manager is further authorized{1} to execute the necessary documents, in a
form acceptable to the City Attorney, to implement the grant.
Section 6. All ordinances or parts of ordinances that are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 7. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance shall become effective immediately upon its adoption and signature
of the Mayor{2}.
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.
