HomeMy WebLinkAboutexhibit.ContractFIRST AMENDMENT TO CONTRACT "SW 11 STREET RECONSTRUCTION PROJECT, B-5699" This First Amendment to the Contract for "SW 11 Street Reconstruction Project" between the Contractor and the City, authorized by the City Commission Resolution No. , dated , 2004, which is deemed as being incorporated by reference as if set for in full herein, is entered into this day of , 2004, by and between the City of Miami, a municipal corporation of the State of Florida (the "City"), and T.J. Pavement Corp., a Florida corporation ("Contractor") for the purpose of amending that certain Contract dated November 3, 2003, between the City and the Contractor (the "Contract") as set forth herein. RECITALS: WHEREAS, pursuant to Resolution No. 03-1009, adopted by the City Commission on September 11, 2003, the City and the Contractor entered into the Contract for the provision of a!1 labor, materials and equipment and performance of all the work in the form and manner provided by the Contract Documents for the project entitled "SW 11 Street Reconstruction Project, B-5699"; and WHEREAS, pursuant to the contract, the City shall pay to the Contractor, the sum of Eighty Three Thousand Two Hundred and Twelve Dollars ($83,212); and WHEREAS, due to unexpected conditions and at the petition of the community, if in some locations it is necessary to add driveways approaches and replace the existing poor condition sidewalks; and WHEREAS, Additional work and materials are required to complete the proposed work in an estimated amount of Eight Thousand Dollars ($8,000); and WHEREAS, the City Commission, by Resolution No. , adopted on February 11, 2004, has authorized an increase in the amount of the Contract by ($8,000) Eight Thousand Dollars. NOW THEREFORE, in consideration of the foregoing and of the mutual agreements and covenants of the parties as set forth in the Contract, the City and the Contractor agree as follows: 1- Term: The term of the Contract shall remain in the same. 2- Compensation: Article 2 of the Contract is hereby amended to increase the amount of compensation from $83,212 to $91,212; the additional amount to be used exclusively for the payment of the additional work in additional asphalt driveways approaches and replacement of damaged sidewalks. Except as provided herein, no other compensation, fee, reimbursable expense, cost, or charge shall be payable by the City. Except as specifically provided herein, all of the terms and provisions of the Construction Contract shall remain in operative force and effect.
