HomeMy WebLinkAboutcover memoCITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM orjuvi(P TO : FROM: The Honorable Mayor and Members of the City Commission rriola, anager DATE: JAN 16 20D4 FILE : SUBJECT : Resolution to Authorize Agreement with Dade County — Participate in River Dredging Project v4 REFERENCES: ENCLOSURES Resolution and Agreement RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution authorizing the City Manager to execute an inter -local agreement with Miami -Dade County for the City's participation in the Miami River Dredging project to dredge both the federal navigational channel and the areas outside the channel, at a cost not to exceed $6,000,000 over a four (4) year period, allocating $1,000,000 in funds from Capital Improvement Project Number 311083 for the first year. BACKGROUND: For the last several years, the City of Miami, Miami -Dade County the U.S. Army Corps of Engineers ("USACE") and many others have labored to design and obtain permits for the dredging of the Miami River. USACE has authorization to proceed with and will administer the work to dredge the federal navigational channel of the Miami River, the "Federal Project". USACE serves as the federal sponsor of the project, and contributes more than 80% of the project costs. USACE advertised a Request for Proposals on August 29, 2003, received proposals on November 21, 2004 and is now finalizing its selection of the most advantageous proposal. In July 2003, Miami -Dade County and USACE entered into an agreement under which the County will serve as the local, or Non -Federal Sponsor of the Federal Project. Pursuant to Resolution No. 00-313, adopted April 13, 2000, the City agreed to a funding plan for the non- federal portion of the Federal Project costs, to wit, the City and County each contribute 25% of the non-federal share and the State of Florida contributes 50% of the non-federal share. Subsequently, the Florida Inland Navigation District has pledged to match both the City's and the County's contributions, excluding those for land. During the course of the project development, it was determined that it is in the best interest of the City, the County and the region that areas outside of the federal navigational channel also be dredged. Specifically, those areas of the river that lay between the federal channel and the river banks were identified as in need of dredging and are referred to as "Local Waters". USACE is prohibited from participating financially in activities to dredge the Local Waters, but has included this work as an option in the RFP and contract documents for the Federal Project, to be exercised at the sole cost and expense of the Non -Federal Sponsor and its funding partners. The City Administration has renegotiated with the County for the cost share of the Local Waters dredging as follows: the County contributes 50%, the Unincorporated Municipal Service Area (UMSA) of the County contributes 12.5% and the City contributes 37.5%. The City and the County further agreed to seek additional funds from the State of Florida and other sources, which, if received will be deducted from the total cost to dredge the Local Waters, thereby reducing all the current parties' shares proportionally. The estimated cost of the Federal Project is $54,000,000 and the estimated cost of the Local Waters dredging is $12,000,000, for a combined total of $66,000,000. The project is expected to be under construction over a 4-year period, beginning mid -year 2004. The total cost to the City for both the Federal Project and the dredging of the Local Waters is anticipated to be $5,850,000 over the four-year period. An analysis of project funding is attached. Both the City and the County have agreed to seek additional funding contributions for the Project, particularly the dredging of the Local Waters. The proposed agreement provides that the City Manager may execute amendments to this Agreement without the necessity of obtaining further City Commission approval to accommodate such funding contributions. The attached agreement provides detailed terms and conditions for the use of the funds by the County and reimbursements by the City for both the Federal Project and the dredging of the Local Waters. The County has programmed the funds into its 2003-04 budget year, and City funds in the amount of $1,000,000 are available for the first year of the project from existing Capital Improvement Project No. 311083. FISCAL IMPACT: This is a budgeted project and will have no fiscal impact. Ultimately, the improved depth of the River should result in increased shipping and trade and in higher property values along the River.
