A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO
THE LEASE AGREEMENT ("LEASE"), IN SUBSTANTIALLY THE ATTACHED
FORM, WITH GOLDEN SANDS ALLAPATTAH CORPORATION ("LESSOR"), TO
EXTEND THE TERM OF THE LEASE FOR A ONE-YEAR PERIOD AT A RATE OF
$14.50 PER SQUARE FOOT WITH THE OPTION TO RENEW THE LEASE FOR
FOUR SUCCESSIVE ONE-YEAR TERMS, EACH WITH FURTHER ANNUAL
INCREASES CALCULATED BASED UPON INCREASES IN THE CONSUMER
PRICE INDEX ("CPI"), BUT NOT TO EXCEED A MAXIMUM ANNUAL INCREASE
OF THREE PERCENT (3%), AND WITH ALL OTHER TERMS AND CONDITIONS
TO REMAIN THE SAME AS SET FORTH IN THE LEASE; FURTHER
ALLOCATING FUNDS FROM THE FOLLOWING ACCOUNT CODES: RENTAL,
001000.290201.6.610 AND ELECTRICITY
(OVERTIME AIR CONDITIONING) 001000.290201.6.540.
WHEREAS, Resolution No. 02-900, adopted July 25, 2002, the City Commission authorized
the City Manager to execute a Lease Agreement ("Lease") with Golden Sands Allapattah
Corporation ("Lessor") for approximately 9,000 square feet of office space ("Premises"), at 1313
Northwest 36th Street, Miami, Florida, to be used by the Department of Police, Division of Internal
Affairs; and
WHEREAS, the City Manager executed the Lease for an initial one-year term with the option to
renew for five successive one-year terms, each under the same terms and conditions with the
exception of the rental amount which shall be negotiated by the parties; and
WHEREAS, the initial term of the Lease expired November 30, 2003, and the Lessor wishes to
extend the Lease; and
WHEREAS, the parties have negotiated that the rental rate for the first renewal term to be the
same as the initial term of $14.50 per square foot; and
WHEREAS, the initial lease requires the Department of Police Division of Internal Affairs to pay
$15.00 per hour for overtime air conditioning usage, which average of air conditioning usage is
approximately 40 hours per month;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.

Section 2. The City Manager is authorized{1} to execute Amendment No. 1, in substantially the
attached form, to the Lease between the City and the Golden Sands Allapattah Corporation, for
the purpose of extending the term of the lease for a one-year period at a rate of $14.50 per square
foot with the option to renew the lease for four successive one-year terms, each with further
annual increases calculated based upon increases in the CPI, but not to exceed a maximum
annual increase of three percent (3%), and with all other terms and conditions to remain the same
as set forth in the Lease, with funds allocated from the following Account Codes:
Rental - 001000.290201.6.610; Electricity (overtime air conditioning) - 001000.290201.6.540.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} This Resolution shall become effective as specified herein unless vetoed by the Mayor within
ten days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.
