RECOMMENDATION:
The administration recommends that the City Commission approve the attached Resolution, authorizing the
City Manager to execute an Amendment to the Lease Agreement (the "Lease"), with Golden Sands Allapattah
Corporation, a Florida corporation ("Lessor") to extend the term of the Lease for a period of one (1) year at a
rate of $14.50 per square foot with four renewal options of one year each, with further annual increases
calculated based upon increases in the Consumer Price Index ("CPI"), but not to exceed a maximum annual
increase of three percent (3%), and with all other terms and conditions to remain the same as set forth in said
Lease. This resolution further allocates funds from the following Account Codes: Rental -
001000.290201.6.610; Electricity (overtime air conditioning) - 001000.290201.6.540.
BACKGROUND:
On July 25, 2002, the City Commission adopted Resolution No. 02 - 900, which authorized the City Manager to
execute an agreement with Golden Sands Allapattah Corporation for approximately 9,000 square feet of space
(the "Premises"), to be used as office space for the Internal Affairs Division of the Miami Police Department,
located at 1313 N.W. 36th Street, Miami, Florida (the "Building"). The Lease included an initial term of one
year, with the option to renew for five (5) successive terms of one (1) year each at a rental amount to be
negotiated by the parties. The City has negotiated that the rental rate of $14.50 per square foot remain the
same for the first renewal term. Thereafter, the annual rent will be adjusted based upon increases in the
Consumer Price Index (CPI) but not to exceed a maximum annual increase of three percent (3%). Additionally,
the initial lease requires Police Department to pay $15.00 per hour for overtime air conditioning usage. Police
Department averages 40 hours per month of overtime air conditioning usage. The Internal Affairs Division of
the Miami Police Department would like to continue occupancy of the Premises and renew the Lease.
Financial impact: The financial impact to the City general fund for the fiscal year 2003-2004 is $137,700
paid in monthly installments of $11,475 ($10,875 for rent plus approximately $600 for overtime air
conditioning expense).
