HomeMy WebLinkAboutR-04-0055City of Miami Legislation Resolution: R-04-0055 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00027 Final Action Date: 2/12/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, APPROVING THE ALLOCATION OF ADDITIONAL FUNDS, IN THE AMOUNT OF $255,275, TO CONTINUE FUNDING THE OPERATIONS AND OTHER RELATED EXPENSES AS INCURRED BY THE FORFEITURE FUND DETAIL FOR THE DEPARTMENT OF POLICE; ALLOCATING FUNDS FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NO. 690003, SUCH EXPENDITURES HAVING BEEN CERTIFIED BY THE CHIEF OF POLICE AS COMPLYING WITH THE UNITED STATES DEPARTMENT OF TREASURY "GUIDE TO EQUITABLE SHARING." WHEREAS, Resolution No. 86-665, adopted September 11, 1986, authorized the expenditure of forfeiture generated monies from the Law Enforcement Trust Fund to establish and operate a Forfeiture Fund Detail ("Detail") to provide administrative and investigative support related to the seizure and forfeiture of property as delineated in the Florida Contraband Forfeiture Act and the United States Department of Justice and Treasury's "Guide to Equitable Sharing;" and WHEREAS, costs associated with the operation of the Detail include such expenses as salaries for support personnel (e.g., court reporters, administrative aides, clerks, temporary office clerks, property specialists, accountants, etc.), title transfers, filing fees, transcripts, towing charges, payment of liens, and other forfeiture related expenses; and WHEREAS, the United States (U.S.) Department of the Treasury "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes (2001), authorize the expenditure of forfeiture cash or proceeds for law enforcement purposes; and WHEREAS, the Chief of Police has recommended adoption of this Resolution and has determined that the expenditures proposed comply with the U.S. Department of Treasury "Guide to Equitable Sharing;" and WHEREAS, funds to cover the necessary expenses and costs are available in the City of Miami Law Enforcement Trust Fund, Project No. 690003, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of additional funds, in the amount of $255,275, to continue funding the operations and other related expenses as incurred by the Forfeiture Fund Detail for the Department of Police is approved, with funds allocated from the Law Enforcement Trust Fund, City of Miami Page 1 of 2 File Id: 04-00027 (Version: 1) Printed On: 8/30/2016 File Number: 04-00027 Enactment Number: R-04-0055 Project No. 690003, such expenditures having been certified by the Chief of Police as complying with the U. S. Department of the Treasury "Guide to Equitable Sharing." Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
