HomeMy WebLinkAboutO-12473City of Miami Legislation Ordinance: 12473 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0408 Final Action Date: 1/22/2004 (4/5THS VOTE) AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED "2004 STATE CHALLENGE HOMELESS GRANT" AND APPROPRIATING FUNDS, IN THE AMOUNT OF $6,606.36, CONSISTING OF A GRANT RECEIVED FROM THE STATE OF FLORIDA, STATE CHALLENGE GRANT PROGRAM FOR THE PORTION OF THE CITY OF MIAMI'S HOMELESS PROGRAM MATCHING FUNDS REQUIREMENTS TO PROVIDE OUTREACH, ASSESSMENT, PLACEMENT AND TRANSPORTATION SERVICES TO THE HOMELESS WITHIN THE CITY OF MIAMI, FLORIDA, FOR A PERIOD OF SIX MONTHS; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; FURTHER AUTHORIZING THE ALLOCATION OF SAID FUNDS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following new Special Revenue Fund is established and resources are appropriated as described below: FUND TITLE: 2004 STATE CHALLENGE HOMELESS GRANT $6,606.36 RESOURCES: STATE OF FLORIDA CHALLENGE GRANT APPROPRIATIONS: $6,606.36 Section 2. The appropriation is contingent upon the receipt of the grant from the State of Florida and the City Manager's acceptance thereof. Section 3. The City Manager is authorized{1} to accept a grant from the State of Florida, Challenge Grant Program, in the amount of $6,606.36, for the portion of the City of Miami's Homeless Program matching funds requirement, to provide outreach, assessment, placement and transportation services to the homeless within the City of Miami, Florida, for a period of six months. The City Manager is authorized{1} to execute the necessary documents (s), in a form acceptable to the City Attorney, to implement the grant. Section 5. All ordinances or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of the Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance is declared to be an emergency measure on the grounds that of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments of its debts, purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 8. The requirement of reading this Ordinance on two separate days is dispensed with by an affirmation vote of not less than four -fifths of the members of the Commission. Section 9. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
