Cano Director Capital Improvement Department DATE: December 18th, 2003 FILE: B-3282 susJEcr: Addendum Number One Water and Sewer Agreement "Old Virginia Key Beach Park Project, B-3282" - Justification REFERENCES: ENCLOSURES: Seven (7) Documents The original point of connection of the new sewer force main was selected by the City Consultants Johnson Associates Architects, Inc and Leiter, Perez and Associates, Inc, in response to the Virginia Key Beach Park Trust request to include a secondary road design to access the Park. The City of Miami, the City's consultants, Virginia Key Beach Park Trust and DERM visited the site to discuss the route selected. DERM concluded that the selection of the route had direct impact in wetland preservation areas, and Mitigation Plan requirements would be necessary. The mitigation plan would increase the cost of the project, and it was recommended not to include the road in the scope of work because of the limited funds available for the project. Consequently, a new point of connection to an existing twelve (12) inch sewer force main owned and operated by the County, located at the intersection of Rickenbacker Causeway and Virginia Key Beach Access Road, was selected so that wetland preservation areas would not be impacted. The Department of Capital Improvements and the City's consultants agreed to change the point of connection. A request was made to Miami -Dade County for an Addendum to the agreement between Miami -Dade County and the City of Miami for the Force Main of "Old Virginia Key Beach Park Renovations & Repairs, project #B-3282, ID # 17967. Addendum Number One refers to the new point of connection as mentioned above and replaces paragraph five (5) of the Agreement. In addition, the County will impose construction connection charges in an event that another party connects to the portion of the force main constructed by the City or outside of the City property. The County shall repay said construction charges to the City within ninety days (90) of receipt of same, as stated in paragraph thirty-three (33) as added to the Agreement. The Department of Capital Improvements recommends that the City Commission adopt a Resolution authorizing the City Manager to execute Addendum Number One to the agreement between Miami -Dade County and City of Miami for the Force Main of "Old Virginia Key Beach Park Renovations & Repairs, project #B-3282, ID # 17967.
