HomeMy WebLinkAboutR-04-0037City of Miami Legislation Resolution: R-04-0037 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0403 Final Action Date: 1/22/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING AN INCREASE IN THE CONTRACT AWARDED TO REGOSA ENGINEERING INC., PURSUANT TO RESOLUTION NO. 03-859, ADOPTED JULY 24, 2003, FOR THE PROJECT ENTITLED "OLD VIRGINIA KEY BEACH PARK RENOVATIONS AND REPAIRS, B-3282A," IN AN AMOUNT NOT TO EXCEED $126,000, INCREASING THE CONTRACT AMOUNT FROM $1,108,179 TO $1,234,179, TO COVER COSTS OF ADDITIONAL WORK AND MATERIALS REQUIRED; ALLOCATING FUNDS FOR SAID INCREASE FROM CAPITAL IMPROVEMENTS PROJECT NO. 333130; AMENDING RESOLUTION NO. 03-859 TO REFLECT SAID INCREASE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT TO THE CONTRACT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 03-859, adopted July 24, 2003, the City of Miami and "Regosa Engineering, Inc.("Contractor") entered into a Contract for the Project entitled "Old Virginia Key Beach Park Renovations and Repair Phase I, B-3282A" dated September 10, 2003; and WHEREAS, the proposed work consists of the renovations and repairs of the existing buildings at Virginia Key Beach Park; and WHEREAS, the sum of contract costs, subject to additions and deductions and based on the sum and unit prices, as provided in the project proposal and other contract documents, totaled $1,108,179; and WHEREAS, due to the award of the contract amount without including the Deductive Items until identification of additional funds needed to cover said items; and WHEREAS, additional funds, in an estimated amount not to exceed $126,000, to cover costs of additional work and materials required to complete the project; and WHEREAS, said funds are available from Capital Improvements Project ("CIP") No. 333130; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. An increase in the contract awarded to Regosa Engineering, Inc., in the amount of $126,000, is authorized, to cover costs of additional work and materials required and Resolution No. 03-859, is amended in the following particulars:{1} "Resolution No. 03-859 Section 1.The bid of Regosa Engineering, Inc., for the project entitled "OLD VIRGINIA KEY BEACH PARK RENOVATIONS AND REPAIRS, PHASE I, B-3282A" is accepted, in the amount of $1,108,179 $1,234,179 for contract costs plus $122,660 for estimated expenses incurred by the City, for a total project cost of $1,230,839$1,356,839, with funds allocated from capital Improvements Project No. 331416, Virginia Key Wildlife Environmental Center No. 333128 and Virginia Key Beach Park Trust Account No. 116004. *II Section 3. Funds for said increase are allocated from Capital Improvements Project No. 333130. Section 4. The City Manager is authorized{2} to execute the First Amendment to the Contract, in substantially the attached form, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{3} Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, but not limited to those prescribed by applicable provisions of the City Charter and Code. {3} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
