HomeMy WebLinkAboutFact SheetPOLICE AGENDA ITEM SUMMARY FACT SHEET AMENDING CITY CODE 46-1 JUSTIFICATION: Existing City Code Section 46-1 requires that the seven complaints of unlawful activity within a six months period must occur before enforcement action for a public nuisance may commence. Recently, the Florida Statues have been amended to require two complaints of unlawful activity within the same period of time and the definition of a public nuisance has been expanded thus the City Code is no longer consistent with the provision of the state. The ordinance has been drafted to amend City Code Section 46-1 to be consistent with Florida Statues related to the definition of a public nuisance and the number of violations required for a property to be declared a public nuisance. HOW IS THIS ITEM GOING TO ENHANCE THE QUALITY OF SERVICE TO THE CUSTOMER / CITIZENS? It is the intent of this Ordinance to promote, protect, and improve the health, safety and welfare for the citizens of the City of Miami by providing a mechanism to impose administrative fines and other non -criminal penalties to provide and equitable, expeditious, effective, and inexpensive method of enforcing ordinances in the City of Miami.
