Fernandez, Assistant to Chief of Operations Services DATE : FILE December 23, 2003 SUBJECT: Adopting Florida Department of Transportation (FDOT) Request for e a---- Proposal: General Consultant s, REFERENCES : Engineering Services- irector FM Nos. 41165913201 & 41165923201 ENCLOSURES: The above mentioned Florida Department of Transportation (FDOT) Request for Proposal (RFP) for General Consultant Engineering has been reviewed by me to determine whether the City of Miami can piggyback on the solicitation for the provision of General Consultant Engineering Services. My review of the material submitted to my office revealed the following: • A Request for Proposal was issued by FDOT; • Section 1.0 of the RFP, specifically states that FDOT advertised the projects requiring General Consultant Engineering Services; • The four firms short-listed consisted of: (1) Consul -Tech Engineering, Inc., (2) Keith and Schnars, P.A., (3) Post, Buckley, Schuh and Jernigan, Inc., and (4) URS Corporation Southern; • The consultants short-listed were required to submit a written technical proposal with their respective certification/standard consultant technical forms; • A meeting was held with the four short-listed firms to discuss the scope of services; • Based from that meeting, all firms were provided with three (3) work sample projects, and were required to submit their technical written proposal. Proposals were evaluated using the following criteria: (1) Awareness of Project Issue, (2) Approach to the Project, (3) Project Staffing, (4) Other Consideration (i.e. Disadvantaged Business Enterprise, Schedule of Events, Responsible Office, Project Coordination, Quality Control and Constructability Issues); • Section 8.0, Consultant Selection, of the RFP solicitation clearly expresses that an agreement will be awarded to two (2) out of the four (4) short-listed firms; • Contractual Term with the selected firms is for 24 months with option to extend to a maximum of five (5) years at the option of FDOT. • On March 19`1i, 2002, a standard professional services agreement was executed by FDOT and, one out of the two firms, Consul -Tech Transportation, Inc. for a period of twenty four (24) months. • The contractual period is effective until March 19, 2004, with a possible option of extending the contract until March 19, 2007. • On March 19, 2002, FDOT issued a Notice to Proceed to Consul -Tech Transportation Pursuant to Section 18-111, Contracts of other governmental entities, the City may, in lieu of other city competitive bidding procedures, accept a competitive bid which has been secured by a state government, subject to a determination by the Chief Procurement Officer that the contract was entered in compliance with city laws, policies and procedures. Thus, it is my determination on the materials reviewed that the above mentioned Florida Department of Transportation Request for Proposal is in compliance with the State of Florida Statutes 287.055 (Consultants' Competitive Negotiations Act "CCNA") and city laws, policies and procedures; and, therefore can be adopted by the City of Miami.
