Dear Colleagues:
At the CRA Board meeting on Monday, July 26, 2004, the Interim City Attorney advised
the Board of Directors of the pending reassignment of the current CRA city staff
attorney, Jim Villacorta. Needless to say, this personnel decision came as a shock and
evoked considerable discussion among the Board Members present. It was also disclosed
that although the CRA is paying 100% of Mr. Villacorta's salary, over the past six
months, he has only been available to the CRA approximately 60% of the time. Further,
it was learned that a number of other City agencies are involved and will have their city
staff attorney reassigned in spite of expressed concern of their respective Boards (i.e.
Bayfront Park Trust).
As Chair of the Commission, in the past I have chosen to minimize and ignore the recent
"snafus" on the consent agenda related to the street co -designation, but on cold reflection,
I have determined that the "snafu" is symptomatic of a very deep and real (legal)
management problem that should be addressed immediately. This is particularly
troublesome in light of the upcoming budget hearings and the specific consideration of
the proposed budgets for the City NET and Departments of Communications, Human
Resources, and Parks & Recreation
This correspondence is to advise you of my intention to urge the Commission to consider
the following issues as the first order of business at the Commission meeting on
Thursday, July 29, 2004, at 9:00a.m:

1. Selection of the City Attorney [See Meeting Agenda Item # DI.1(04-00842)].
2. Discussion to defer selection of the City Attorney to September 9, 2004.
3. Appointment of a one -person committee (preferably the Commissioner with
the least longevity) as the compensation and benefits committee for the City
Attorney designee and to report back at the next regularly scheduled City
Commission meeting (September 9, 2004).

Dear Colleague:
Please find attached the memorandum dated July 22, 2004 Re: City Attorney Selection
Committee's Recommendations for Position of City Attorney, signed by both Alejandro
Vilarello and the undersigned.
This memo respectfully recommends that "final action" be taken on the subject memo,
(subject to any "unreadiness by any single Commissioner"), be scheduled for Thursday,
July 29, 2004, of the City Commission meeting. If there are concerns on this timeline
and approach, I would then recommend that each Commissioner schedule private
(individual) meeting(s) with each of the three (3) applicants prior to 2:00 p.m., Thursday,
July 29. To assist and facilitate the administration of these meetings, the City Clerk has
designated the following individual to be available to each Commissioner and further to
stay in close and constant contact with each of the three (3) applicants for the next seven
(7) days:

City Attorney Selection Committee's Recommendations for Position of City
Attorney
Pursuant to Commission Resolution R-04-0305, adopted May 6, 2004, which established
the City Attorney Selection Advisory Committee ("Committee") to advertise and review
applications for the position of City Attorney, and make recommendations to the City
Commission, said Committee held three publicly noticed meetings.
Each Committee member reviewed every candidate's application and submitted an
evaluation report to the Committee, utilizing an agreed upon methodology. On July 21, 2004, the
Committee met and the members present considered all eva7ivation-reports collegially -evaluated
the candidates and determined, utilizing the reports, a consensus recommendation of the most
qualified candidates. The Committee then voted to recommend the consensus top three
candidates to the City Commission for its review and cons ?'o s for the position of City
Attorney. Said candidates, in alphabetical order, are: W ren B' t r, Julie O. Bru and Jorge L.
Fernandez.
