Consideration of amending Ordinance 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, by amending Articles 4, 5, 6, 7, 8, 9, 11, 12, 13, 14, 15, 16, 17, 19,
22 and 25, in order to add, delete and clarify language pertaining to special permits, uses
and characteristics of use and criteria for review of zoning applications, definitions and
use limitations, and to modify other language throughout the zoning ordinance for
consistency.

The proposed ordinance is an amendment, which encompasses the entire zoning
ordinance as it relates to the following 4 types of amendments:
1. General Ordinance clean up and update;
2. Restructuring of special permits;
3. Clarification of special permit criteria and augmentation as necessary; and
4. Ordinance modifications of obsolete language or other changes for consistency
with intent or as directed by the City Commission.
The purpose of this amendment is primarily to clarify and augment criteria language for
the City's special permits under a proposed new structure for special Permits. This intent
is being carried out by clearly defining the purpose of each special permit as well as
variances and then modifying and adding new criteria as necessary to allow for a clearer
ability by the Planning and Zoning Department to administer the approval process for
each.
The new structure sets out to redefine the special permits as follows:
■ Class I Special Permits will now be related to temporary uses and occupancies;
• Class II Special Permits will now be related to issues of design;
■ Special Exception Permits will now be related to permanent uses and
occupancies that have potential adverse effects and need special review; and
• Major Use Special Permits will continue to be related to higher thresholds of
development and projects consisting of development bonuses.
The proposed ordinance also modifies the criteria for variances to include review of
impacts associated with variances as they relate to design and use. This amendment is
being proposed so that additional consideration can be given to impacts associated with
variances on a case -by -case basis as necessary. This is important in recognition of the
diversity of Miami's neighborhoods and the need to ensure that when variances are
being considered, that the impacts associated with them are considered throughout the
review process.
The remainder of the changes are primarily related to general clean up of the ordinance
and other changes deemed necessary as a result of the new structure. The proposed
ordinance provides a clearer framework for both the public and the City's administration
in the review and approval process of special permits and variances. Other modifications
are also included where clarifications as to regulations and procedures were deemed
necessary.
