HomeMy WebLinkAboutcover memoSecond Reading Ordinance CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM SR.5 The Honorable Mayor and Members of the City Commis Joe Arrioia Chief AdMinij trator/City Manager DATE: SUBJECT : REFERENCES: ENCLOSURES: NOV 14 2003 Proposed Ordinance FILE : Investigative Cost Recovery Fund RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Ordinance establishing a Special Revenue Fund entitled: "Investigative Cost Recovery Fund," authorizing acceptance of judgments rendered against persons convicted in criminal cases, pursuant to Florida Statute, Chapter 938.27, and appropriating said funds, in an amount not to exceed $5,000, for use by the Police Department's Environmental Protection Unit. Although, this cost recovery fund is available to all investigative units, this particular account will initially collect judgments on behalf of this unit only without precluding other units in the future. BACKGROUND Florida State Statute, Chapter 938.27 — Judgment for costs on conviction states that in all criminal cases the costs of prosecution, including investigative costs incurred by law enforcement agencies, by fire departments for arson investigations, and by investigations of the Division of Financial Investigations of the Department of Banking and Finance, if requested and documented by such agencies, shall be included and entered in the judgment rendered against the convicted person. These funds will by used toward the payment of training, equipment, rentals, emergency clean-ups, special operations, and overtime, and any other investigative costs incurred by the Police Department's Environmental Protection Unit during the investigation, and later this Special Revenue Fund could be expanded to include other units.
