Method for the Vacation and
Closure of Alleys

We would respectfully request that the City Commission favorably consider the adoption of the
attached ordinance. The ordinance provides an alternative mechanism that citizens residing in R1
and R2 zoning districts can avail themselves of for the closure of an alley way in addition to the
traditional platting process.
BACKGROUND:
The attached ordinance is the administration's response to direction provided by the Mayor and City
Commission in an attempt to address the repeated complaints of city residents with respect to the
derelict condition of and illicit activities occurring within some alleyways located throughout the city.
Chapter 55 of the Code of the City of Miami currently requires that the applicant requesting the alley
or street closure record an amended plat showing the alley or street or portion thereof as being
closed.
The ordinance before you for consideration provides an alternative method for the closure and
vacation of both private and public alleys abutting parcels in R-1 and R-2 zoning districts only.
Under the proposed ordinance, a request to close a public alley way can be initiated by the City
Manager independent of or at the request of the City Commission during the first sixty (60) days of
the calendar year. A property owner, whose property abuts an alley and is located within the
permitted zoning districts, can also file an application for a closure within the same time period.
The ordinance sets forth the required elements of the alley closure application, the requirements for
notification of impacted property owners, the stages of review, and the appeal process for denied
applications. The alternative method for vacation and closure of alleys outlined herein should result
in significant time and monetary savings to city residents.
