HomeMy WebLinkAboutR-03-1255City of Miami Legislation Resolution: R-03-1255 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0345 Final Action Date: 12/18/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION REQUESTING THE CITY MANAGER, DUE TO EXTENUATING CIRCUMSTANCES, TO DIRECT THE ADMINISTRATION TO ASSIST IN THE PREPARATION OF A REFILED VARIANCE REQUEST BY AN INFIRMED SENIOR CITIZEN, MR. JOSE ESCALONA, AND WAIVE ALL FEES ATTENDANT TO SAID APPLICATION FOR PROPERTY LOCATED AT APPROXIMATELY 51 SOUTHWEST 52ND COURT. WHEREAS, the City Commission adopted Resolution No. 02-481 on April 25, 2002, reversing a decision of the Zoning Board and granting a variance to Mr. Jose Escalona, for a specific term of one year; and WHEREAS, through a set of very unfortunate circumstances the property owner, an elderly individual, was unaware of said time limitation when he initiated the requisite architectural and Building and Planning review process in furtherance of his then authorized variance; and WHEREAS, the property owner's progress was interrupted by a serious and extensive illness during which time the Commission's one year time period granted for him to pull a building permit expired; and WHEREAS, the property owner, Mr. Jose Escalona, had previously paid all requisite fees, but due to his health conditions and unfamiliarity with the regulations, unintentionally allowed the time to file for an extension to expire, yet all the while paying for review of the necessary plans, professional fees, etc.; and WHEREAS, It is not intended that the herein request constitute a precedent for future permits, but is solely intended to address and alleviate the imposition of a particularly egregious situation; and WHEREAS, the subject applicant shall still have to satisfy all other requirements and reviews related to his new variance application; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is requested to direct the Administration to assist in preparation of a refiled variance request by an infirmed senior citizen, Mr. Jose Escalona, due to extenuating circumstances, and to waive all fees attendant to said application for property located at City of Miami Page 1 of 2 File Id: 03-0345 (Version: 2) Printed On: 8/23/2016 File Number: 03-0345 Enactment Number: R-03-1255 approximately 51 Southwest 52nd Court. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
