HomeMy WebLinkAboutCover memoCITY OF MIAMI CITY ATTORNEY'S OFFICE MEMORANDUM SI.3 TO: Mayor and Members of the City Commission FROM: Alejandro Vilarello, City Attorney t' DATE: December 12, 2003 RE: Re -filing of Variance Application for property located at 51 SW 52nd Court, Miami, Florida - Assistance and Waiver of Fees At the request of Commissioner Tomas Regalado, the attached discussion item regarding the re -filing of an application for a previously approved variance from an elderly and infirmed citizen is placed on the December 18, 2003 Supplemental Agenda for your consideration to waive the fees associated with a variance application re -filing. The property's owner, Mr. Jose Escalona, was granted a variance by the City Commission on April 25, 2002, with the caveat that a building permit be obtained within one year. Because of extenuating circumstances involving medical and communications issues, the time elapsed and Mr. Escalona is left with only one legal option, to refile his petition. The property owner paid all required expenses the first time, and a repetition of the fee exactions will result in an inordinate financial burden on top of the already large financial outlay Mr. Escalona has incurred in his attempts to satisfy the variance. The request pertains solely to fees. The applicant would have to comply with all other requirements for approval of his application from the Zoning Board. c: Mayor and Members of the City Commission Priscilla A.
