HomeMy WebLinkAboutAnalysisANALYSIS FOR SPECIAL EXCEPTION 2801 Florida Avenue CASE NO. 2003-0672 Pursuant to Article 6, Section 602 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to allow a supper club use at 2801 Florida Ave. The following findings have been made: • It is found that the proposed supper club use is located within the SD-2 District in Coconut Grove and is therefore compatible with the area. • It is found that the required parking is not been provided on site. • It is found that the subject proposal has been reviewed and found in compliance with the following factors: ingress and egress, offstreet parking and loading, refuse and service areas, signs and lighting, utilities and drainage. • It is found that regarding control of potentially adverse effects generally, the proposed supper club use, due to the late hours of operation permitted in conjunction with liquor sales, may have an adverse effect on nearby residential areas for the latter part of its nightly operations (more specifically, for any operational time after 2 A.M.). Specific concerns are related to security and offsite parking within the adjacent neighborhood at such a late hour. • It is found that this analysis is based on the proposal presented for "Quench" only and should not apply to any future supper club proposals for the same location. • It is found that the subject proposal has been reviewed and found in compliance with the criteria as set forth in Section 1305 of Zoning Ordinance 11000. • It is found that upon compliance with conditions set forth below, this project will not have any adverse impacts on the surrounding area. Based on these findings, the Planning and Zoning Department is recommending approval of the application with the following conditions: 1. Approval of this special exception shall run with this operator only; any changes to a different operator shall require a separate Special Exception. 2. The proposed facility shall provide security during the operating hours between 2 A.M. and 5 A.M.; the applicant shall submit a revised and approved security plan by the Police Department, which specifies the number of security personnel and locations for said personnel to be posted, for review and approval by the Planning Department, prior to the issuance of a Certificate of Use as a supper club. 3. This approval is subject to applicant obtaining a parking waivers approved by the Zoning Department along with the Coconut Grove Offstreet Parking Advisory Committee review and comments prior to the issuance of a building permit. 4. In order to discourage enforcement problems with underage patrons during "nightclub" hours, no one under the age of 21 shall be permitted into the club between the hours of 2 A.M. and 5 A.M.
