HomeMy WebLinkAboutR-03-1230City of Miami Legislation Resolution: R-03-1230 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0210 Final Action Date: 12/18/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO INITIATE ANY AND ALL ACTION, IN LAW OR IN EQUITY, RELATED TO NON-COMPLIANCE WITH THE TERMS OF AGREEMENTS BETWEEN BAYFRONT PARK MANAGEMENT TRUST AND CERTAIN ENTITIES USING BAYFRONT AND BICENTENNIAL PARKS. WHEREAS, pursuant to Sections 38-102, 38-104 and 38-105, of the Code of the City of Miami, and Resolution No. 94-204, adopted on March 24, 1984, Bayfront Park Management Trust ("Trust") is authorized to manage Bayfront Park and Bicentennial Park, respectively, and enter into agreements for the use thereof; and WHEREAS, the Trust has determined that certain entities have not complied with the terms of their Agreements with the City and the Trust, and has authorized all legal actions be taken to compensate for the damages therefrom; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Attorney is authorized{1 } to initiate any and all action, in law or in equity, related to non-compliance with the terms of the agreements between Bayfront Park Management Trust or the City and the entities listed below: Name of Entity Date Agreement entered into: Quik Park of Florida, Inc. December 1999 Velo Racing Inc. October 2001 Shake -A -Leg, Inc. and July 2002 Shake -A -Leg Miami, Inc. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
