RE: Resolution auth� ing the C Attorney to ini : to legal actions
on behalf of th ity of Mi . i and Bayfront Park Management Trust
Pursuant to the provisions of Sections 38-102, 38-104 and 38-105 of the Code of the City
of Miami, Florida, as amended, and pursuant to Resolution No. 94-204, Bayfront Park
Management Trust ("Trust") is authorized to manage Bayfront Park and Bicentennial Park and
enter into agreements for the use the parks. The Trust has determined that various entities have
not complied with the terms of their agreements and would like for the City Attorney to initiate
any and all legal actions, in law or in equity, to recompense the City and the Trust for the
damages suffered therefrom. Therefore, it is recommended that the City Commission approve
the attached resolution authorizing the City Attorney to initiate any and all legal actions to
protect, preserve and defend the interests of the City and the Trust, including, but not limited to,
any action authorized by law or in equity, to obtain any relief or to remedy any losses or damages
to the City of Miami and the Trust related to noncompliance of the terms and conditions of the
agreements for use of the parks.
