HomeMy WebLinkAboutR-03-1229City of Miami Legislation Resolution: R-03-1229 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0283 Final Action Date: 12/18/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE COLLEGE ("MDC"), FOR AN INITIAL THREE-YEAR PERIOD, WITH THE OPTION TO EXTEND THE AGREEMENT FOR ONE ADDITIONAL THREE-YEAR PERIOD, TO PROVIDE EDUCATIONAL PROGRAMS AND ACTIVITIES FOR AT -RISK YOUTHS, TEENAGERS, CHILDREN, ELDERLY CITIZENS, AND FAMILIES LIVING IN THE NEIGHBORHOODS NEAR CITY -OWNED PROPERTY KNOWN AS JOSE MARTI PARK, LOCATED AT APPROXIMATELY 353 SOUTHWEST 4TH STREET, MIAMI, FLORIDA. WHEREAS, on July 16, 1996, the Miami -Dade County Commission enacted Ordinance 96-115, the Safe Neighborhood Parks Ordinance, which authorized issuance of general obligation bonds for the purpose of financing capital improvement programs for certain parks; and WHEREAS, as a result of this ordinance and bond program, the City of Miami ("City") committed $1,790,000 for the planning and construction of a new building with approximately 11,000 square feet at the Park ("Community Center"); and WHEREAS, Miami -Dade College ("MDC") received grant funds, in the amount of $288,908, from the United States Department of Housing and Urban Development, and will contribute funds, in the amount of $161,681, to the City for construction of the Community Center, and the remaining balance towards its services and equipment to implement its educational programs at the Community Center; and WHEREAS, entering into partnerships with non-profit organizations to operate educational programs and activities will reduce the amount of City's funds required for operation of the community center; and WHEREAS, the City Commission determines that it is in the best interest of the City to enter into an Interlocal Agreement ("Agreement") with MDC to provide educational programs and activities for at -risk youths, teenagers, children, elderly citizens, and families living in the neighborhoods near the Park; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with MDC, for an initial three-year period, with the option to extend the Agreement for one additional three-year period, to provide educational programs and activities for at -risk youth, teenagers, children, elderly citizens, and families living in the neighborhoods near City -owned property known as Jose Marti Park, located at approximately 353 Southwest 4th Street, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
