RECOMMENDATION:
The administration recommends that the City Commission adopt the attached Resolution authorizing the
City Manager to execute an Interlocal Agreement, in substantially the attached form, with Miami -Dade
College ("MDC") a political subdivision and educational institution of the State of Florida, for the
provision of educational programs at the community center under construction at the City -owned property
located at 353 South West 4th Street, Miami, Florida, commonly known as Jose Marti Park (the "Park").
The educational programs may include, from time to time, lectures, classes (homework, tutoring,
computer, research) adult education, parenting classes and community activities for teenagers, children,
elderly and families but mainly to at risk youth. of the City living in the neighborhoods adjacent to the
Park, with an initial term of three (3) years and with the mutual option to extend the agreement for an
additional term of three (3) years.
BACKGROUND:
On July 16, 1996, the Miami -Dade County Commission enacted Ordinance 96-115, the Safe
Neighborhood Parks Ordinance that authorized issuance of general obligation bonds for the purpose of
financing capital improvement programs for certain parks. As a result of this ordinance and bond
program, the City has committed at least $1,790,000 to the planning, design and construction of a new
building with approximately 11,000 square feet (the "Community Center"). The Community Center will
include administrative offices, aerobic, dance and gymnastic area, fitness and training room, multipurpose
rooms, computer room, storage, bathrooms and pantry/concession area.
Miami -Dade Community College received a grant from U.S. Department of Housing and Urban
Development in the amount of $288,908 of which they will contribute $161,681 to the construction of the
Community Center and the remaining balance toward its services and equipment to implement its
educational programs at the Community Center.
Financial Impact: There is no negative financial impact to the general fund of the City. Entering
into partnerships with an educational institution to provide educational programs and activities
will reduce the amount of City's funds required for the operation of the Park.

Highlights of the Agreement are as follows:
Term: Three (3) years with the option to extend for an additional term of three (3) years
upon mutual agreement of the parties.

The City will retain the services of MDC to provide educational programs
which may include from time to time, lectures, classes (homework, tutoring,
computer, research) adult education, parenting classes, films, dance
performances, clubs (drama -music) and community activities for teenagers,
children, elderly, families and the unemployed, but mainly to at risk youth living
in the neighborhoods near the Park.
In consideration of MDC's donation of funds for the construction of the building
and its provision of educational services at the Community Center, no additional
charge for its use of the premises will be assessed.
MDC shall raise funds independent of the City for the operation of its
educational programs during the term of this Agreement and any extensions
thereof.
Maintenance MDC shall, at its own cost and expense, provide all maintenance, repairs,
& Repairs: substitutions and replacements, as necessary, to the computer equipment or
related equipment necessary to implement its educational programs.
City Approvals: MDC shall submit a program schedule for the review and approval of the City's
Park Manager.
Termination: Either party may cancel this Agreement at any time without cause by providing
six (6) months prior written notice to the non -canceling party. The funds donated
towards the construction will remain with the City as long as the City uses the
funds in accordance to HUD rules and regulations and provides copies to MDC
of any documentation requested by HUD in connection with the funds received
from the HUD Grant.
