HomeMy WebLinkAboutcover memoCA.13 CITY OF MIAMI CITY ATTORNEY'S OFFICE MEMORANDUM TO: Mayor and Members of the • +mmission FROM: Alejandro Vilarello, DATE: December 3, 20 RE: Resolution f ber 18, 2003 Meeting As you may know, in the past the City has conducted auctions to sell certificates of various types of liens (i.e. lot clearing, sanitary sewer liens, etc.) where the property owner does not pay the municipal liens. After a certain period of time allowed by law, these municipal lien certificate holders then collected on these liens via the tax deed process as permitted by Chapter 197, Florida Statutes (i.e. by submitting to the Tax Collector a "Notice to Tax Collector of Application for Tax Deed"). The above -mentioned process worked well until February of 2003 when Miami - Dade County sent out notices to municipal lien certificate holders indicating that the County Tax Collector's Office will no longer accept municipal liens as a base or part of a tax deed application. In as much as this action could result in good faith municipal lien purchasers being left without a reinedy, the attached resolution authorizes the City Attorneyto take any action in law or in equity, including but not limited to foreclosure, and also delegates that authority to said lienholders.
