HomeMy WebLinkAboutAgenda Item Summary FormAGENDA ITEM SUMMARY FORM File ID: #15525 Date: 02/05/2024 Commission Meeting Date: 03/14/2024 Requesting Department: Department of Human Resources & Department of Police Sponsored By: District Impacted: All Type: Resolution Subject: Execute Interlocal Agreement - Ocupational Health Services Purpose of Item: The nature of this item is to authorize a resolution of the Miami City Commission with attachments, authorizing the City Manager to execute an Interlocal Agreement ("Agreement") pursuant to Section 18-112 of the Code of The City of Miami, Florida, as amended ("City Code") with the Public Health Trust of Miami -Dade County, Florida, an instrumentality agency of Miami -Dade County ("Health Trust"), for the provision of Occupational Health Services, for the Police, and Human Resources Departments, for a period of three (3) years with the option to renew for an additional two (2) year period on a contractual basis pursuant to Section 18-112; allocating funds from the General Account Funds for Police (00001.191501.531020.) and Human Resources (00001.171000.531020.); subject to the availability of funds and budgetary approval, at the time of need; authorizing the City Manager to negotiate and execute any and all documents, including any amendments, renewals, and extensions; subject to all allocations, appropriations, and budgetary approvals having been previously made, compliance with applicable provisions of the City Code, including, the City of Miami's Procurement Ordinance, Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Background of Item: The City of Miami ("City") has a need for the Provision of Occupational Health Services which includes pre -employment physicals for prospective City employees, random drug tests, return to work clearances and yearly physicals for Police. It is recommended that the City enter into an Interlocal Agreement with the Health Trust pursuant to Section 18-112 of the City Code for an annual estimated amount of $450,000.00. WHEREAS, the City of Miami ("City") Police Department ("Police") and Human Resources Department ("Human Resources") have a need for the provision of occupational health services which include pre -employment physicals for prospective City employees, random drug tests, return to work clearances, and yearly physicals for Police; and WHEREAS, in accordance with Section 18-112 of the Code of the City of Miami, Florida, as amended ("City Code"), it is recommended that the City enter into an Interlocal Agreement, in a form acceptable to the City Attorney, with the Public Health Trust of Miami -Dade County, Florida, an instrumentality agency of Miami -Dade County ("Health Trust"), as deemed in the best interest of the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized1 to execute an Interlocal Agreement, in a form acceptable to the City Attorney, pursuant to Section 18-112 of the City Code, for the provision of occupational health services, for Police and Human Resources, with the Health Trust, for an initial period of three (3) years, with the option to renew for an additional two (2) year period. Section 3. Funds shall be allocated from Police General Fund Account No. 00001.190101.531000 and Human Resources General Fund Account No. 00001.171000.531020, and such other sources of funds, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to negotiate and execute any and all documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
