HomeMy WebLinkAboutO-12450City of Miami Legislation Ordinance: 12450 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0222 Final Action Date: 11/25/2003 (4/5THS VOTE) AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING INITIAL RESOURCES FORA SPECIAL REVENUE FUND ENTITLED "LOCAL LAW ENFORCEMENT BLOCK GRANT VIII PROGRAM," AND APPROPRIATING FUNDS, IN THE TOTAL AMOUNT OF $1,448,814, FOR OPERATION OF SAME, CONSISTING OF A GRANT RECEIVED FROM THE UNITED STATES DEPARTMENT OF JUSTICE, IN THE AMOUNT OF $1,303,933, AND REQUIRED MATCHING FUNDS, IN THE AMOUNT OF $144,881, FROM THE CITY OF MIAMI; ALLOCATING FUNDS, IN THE AMOUNT OF $144,881, FROM LAW ENFORCEMENT TRUST FUND, PROJECT NO. 690001, SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH SECTION 932.7055 OF THE FLORIDA STATUTES, AS AMENDED, FOR TOTAL APPROPRIATIONS, IN THE AMOUNT OF $1,448,814; PROVIDING FOR THE APPROPRIATION OF FUNDS FROM INTEREST EARNED FROM FISCAL YEARS 2003-2004 AND 2004-2005 TO BE DEPOSITED INTO SAID FUND; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR ACCEPTANCE OF SAID GRANT AND THE APPROPRIATION OF FUNDS FROM INTEREST EARNED; AUTHORIZING THE EXPENDITURE OF FUNDS FOR OPERATION OF THE PROGRAM; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Section 932.7055 of the Florida Statutes, as amended, authorizes the expenditure of forfeiture cash or proceeds for certain law enforcement purposes not considered normal operating expenses; and WHEREAS, the City of Miami ("City") has a strong interest in reducing crime, and improving public safety; and WHEREAS, the City applied for and received grant funds, in the amount of $1,303,933, from the United States Department of Justice ("USDJ"), Local Law Enforcement Block Grant Program; and WHEREAS, the appropriation of matching funds, in the amount of $144,881, are required from the City of Miami for acceptance of said grant; and WHEREAS, all purchases shall comply with applicable City Code purchasing requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miami Page 1 of 3 File Id: 03-0222 (Version: 2) Printed On: 8/19/2016 File Number: 03-0222 Enactment Number: 12450 FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following Special Revenue Fund is established and initial resources are appropriated for operation of same as described herein: FUND TITLE: LOCAL LAW ENFORCEMENT BLOCK GRANT VII PROGRAM RESOURCES: U.S. Department of Justice $1,303,933 Law Enforcement Trust Fund $ 144,881 APPROPRIATION: $1,448,814 Section 3. The City Manager is authorized{1} to accept the grant from the USDJ and execute any necessary documents, in a form acceptable to the City Attorney, for said purpose, and the deposit into said fund of any earned interest from Fiscal Years 2003-2004 and 2004-2005, is authorized. Section 4. The allocation of matching funds, in the amount of $144,881, from the Law Enforcement Trust Fund, Project No. 690001, such expenditures having been approved by the Chief of Police as complying with Section 932.7055 of the Florida Statutes, as amended, is authorized. Section 5. The expenditure of funds and any interest earned is authorized for the operation of the Program. Section 6. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 7. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 8. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and materials and to generally carry on the functions and duties of municipal affairs. Section 9. The requirement of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. This Ordinance shall become effective immediately upon adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
