Consideration of amending Article 11 of Zoning
Ordinance 11000.

Consideration of amending Ordinance 11000, as
amended, the Zoning Ordinance of the City of Miami,
Florida, by amending Article 11, Section 1102
Nonconforming Tots, in order to clarify language
pertaining to the prohibition of the division of contiguous
nonconforming lots under the same ownership.
Approval.
The proposed amendment is in order to clarify the
provisions regarding contiguous nonconforming lots to
ensure that such lots be developed in accordance with the
intent of these provisions, and to further allow for
development on contiguous nonconforming lots under the
same ownership which meet 90% lot compliance subject
to a Class II Special Permit. This clarification is in order
to make sure that very small contiguous nonconforming
lots under the same ownership be developed as one lot,
yet not penalizing such conditions on larger
nonconforming lots. This was the original intent of this
provision and these clarifications will ensure that the
ordinance is administered accordingly.
Recommended approval to VOTE: 8-0
City Commission.
