A RESOLUTION OF THE MIAMI CITY COMMISSION DECLARING AN
EXEMPTION FROM THE PROHIBITIONS AND RESTRICTIONS CONTAINED
IN SECTIONS 36-4(a) AND 36-5(a) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, AS RELATED TO THE LEVEL AND HOURS OF
NOISE RESULTING FROM THE "MIDNIGHT MIDTOWN MIDWAY" AND "ART
LOVES DESIGN" ART BASEL 2003 RELATED EVENTS ON DECEMBER 4-5,
2003, ON THE BUENA VISTA PROPERTY LOCATED AT 3111 NORTH MIAMI
AVENUE AND IN THE PUBLIC RIGHT-OF-WAY BETWEEN NORTHEAST
41ST STREET ON THE NORTH, NORTHEAST 36TH STREET ON THE
SOUTH, NORTHEAST 2ND AVENUE ON THE EAST, AND NORTH MIAMI
AVENUE ON THE WEST, MIAMI, FLORIDA.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. An exemption is declared from the prohibitions and restrictions contained in
Sections 36-4(a) and 36-5 (a) of the Code of the City of Miami, Florida, as amended, as
related to the level and hours of noise resulting from the "Midnight Midtown Midway" and the
"Art Loves Design" Art Basel 2003 related events on December 4-5, 2003, on the Buena Vista
Property located at 3111 North Miami Avenue and in the public right-of-way between
Northeast 41st Street on the north, Northeast 36th Street on the south, Northeast 2nd Avenue
on the east, and North Miami Avenue on the west, Miami, Florida.
Section 2. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end fo ten
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution,
it shall become effective immediately upon override of the veto by the City Commission.
