HomeMy WebLinkAboutR-03-1197City of Miami Legislation Resolution: R-03-1197 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0238 Final Action Date: 11/25/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH ACAI ASSOCIATES, INC., THE TOP -RANKED FIRM PURSUANT TO REQUEST FOR QUALIFICATIONS NO. 02-03-255, RELATING TO THE CITY'S COMPLIANCE WITH TITLE II OF THE AMERICANS WITH DISABILITIES ACT ("ADA") GENERALLY, TO CONDUCT A SURVEY AND PREPARE A PROTOCOL TRANSITION PLAN ("PLAN") FOR CITY OF MIAMI PARKS, PUBLIC FACILITIES AND RIGHTS -OF -WAY, AS DIRECTED; FURTHER AUTHORIZING THE CITY MANAGER TO SUBSEQUENTLY NEGOTIATE WITH SECOND- AND THIRD -RANKED FIRMS, RODRIGUEZ ARCHITECTS AND ADAAG CONSULTING SERVICES, LLC ("ACS"), IN RANK ORDER, IF AN AGREEMENT CANNOT BE REACHED WITH THE HIGHEST -RANKED FIRM; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN AN AMOUNT NOT TO EXCEED $200,000, TO PROVIDE AN IMMEDIATE SURVEY AND TRANSITION PLAN FOR CITY OF MIAMI PARKS; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENTS PROJECT NO. 331419 FOR SAID PURPOSE; AND DIRECTING THE CITY MANAGER TO PRESENT THE NEGOTIATED AGREEMENT FOR THE REQUIRED BALANCE OF PROFESSIONAL SERVICES TO THE CITY COMMISSION FOR ITS CONSIDERATION. WHEREAS, it is necessary to acquire the services of a qualified firm to research and prepare necessary documents for the City's compliance with Title II of the Americans with Disabilities Act ("ADA") generally, to conduct a survey and to prepare a Protocol Transition Plan for the City of Miami parks, public facilities and rights -of -way, as directed; and WHEREAS, funds for said services are available from Capital Project No. 331419 entitled "Citywide Neighborhood Park Improvements"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to negotiate a professional services agreement, in substantially the attached form, with ACAI Associates, Inc., the top -ranked firm pursuant to Request for Qualifications No. 02-03-255, relating to the City's compliance with Title II of the Americans With Disabilities Act ("ADA") generally, to conduct a survey and prepare a Protocol Transition Plan ("Plan") for City of Miami parks, public facilities and rights -of -way, as directed. Section 3. The City Manager is further authorized{1} to negotiate with the second- and City of Miami Page 1 of 2 File Id: 03-0238 (Version: 2) Printed On: 8/22/2016 File Number: 03-0238 Enactment Number: R-03-1197 third- ranked firms (Rodriguez Architects and ADAAG Consulting Services, Inc., respectively) if an agreement cannot be reached with the highest ranked firm, until an agreement can be reached. Section 4. The City Manager is further authorized{1} to execute an agreement, in an amount not to exceed $200,000 with the first-, second- or third -ranked firm, as applicable, to provide an immediate survey and transition plan for City of Miami parks, with funds allocated from Capital Improvements No. 331419 for said purpose. Section 5. The City Manager is directed to present an negotiated agreement to the City Commission for its consideration for the balance of the required professional services. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor{2}. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
