A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT
TO CONTRACT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MORLIC
ENGINEERING CORP., TO EXTEND THE TERM OF THE CONTRACT FOR
THIRTY (30) ADDITIONAL CALENDAR DAYS, AWARDED BY RESOLUTION
NO. 03-860, ADOPTED JULY 24, 2003; AND TO INCREASE THE CONTRACT,
IN AN AMOUNT NOT TO EXCEED $300,000, FROM $999,699 TO $1,293,699,
TO COVER COSTS OF ADDITIONAL WORK, TESTS AND MATERIALS
REQUIRED TO COMPLETE THE PROJECT ENTITLED, "ROAD
REHABILITATION PROJECT, B-4652;" ALLOCATING FUNDS FROM CAPITAL
IMPROVEMENTS PROJECT NO. 313855, ENTITLED "OCTOBER 2000 FLOOD
RECOVERY," FOR SAID INCREASE.
WHEREAS, Resolution No. 03-860, adopted July 24, 2003, authorized the engagement of
Morlic Engineering Corp. ("Morlic") for the project entitled "Road Rehabilitation Project, B-4652"
and an Agreement between the City of Miami and Morlic was executed on September 2, 2003;
and
WHEREAS, the initial term of the Contract was 150 calendar days completion time after
beginning the construction, and the contract sum, subject to additions and deductions and based
on lump sum and unit prices, all as provided in the proposal and other contract documents, the
sum of $993,699, and
WHEREAS, the proposed work consists of removing the asphalt, reworking the existing lime
rock base, new asphalt pavement and limited drainage improvements; and
WHEREAS, due to unexpected conditions, the existing lime rock base cannot be reworked
because it has thickness oscillating from zero (0) to eight (8) inches instead of the no less than
eight (8) inches as stipulated by the City Standards; and
WHEREAS, the existing lime rock base shall be removed and new lime rock base shall be
constructed; and
WHEREAS, additional work, tests and materials are required to accomplish the proposed
work, in an amount of $300,000, and
WHEREAS, funds for this additional work are available from Capital Improvement Project
("CIP") No. 313855;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an the First Amendment to
Contract, in substantially the attached form, with Morlic Engineering Corp., to extend the term of
the contract for thirty (30)additional calendar days, awarded by Resolution No. 03-860, adopted
July 24, 2003, and to increase the contract, in an amount not to exceed $300,000, from $999,699
to $1,293,699, for the "Road Rehabilitation Project, B-4652", with funds allocated from Capital
Improvements Project No. 313855, entitled "October 2000 Flood Recovery," for said increase.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{1}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
