COMPLAINT TO QUIET TITLE 5101 RE CO LLC, a foreign limited liability company ("Plaintiff'), sues City of Miami, a municipal corporation and political subdivision of the State of Florida ("City" or "Defendant"), and alleges as follows: PARTIES, JURISDICTION, AND VENUE l . This is an action to quiet title in real property located in Miami -Dade County, Florida pursuant to FLA. STAT. §65.061. 2. Plaintiff is a foreign corporation and owns real property located in Miami -Dade County, Florida, which property is at issue in this dispute. 3. Defendant is a municipal corporation and subdivision under the laws of the State of Florida and is located in Miami -Dade County. 4. Because the Property (as defined below) at issue is located in Miami -Dade County, Florida (the "County"), venue is proper in the County pursuant to FLA. STAT. §47.051. 5. This Court has subject matter jurisdiction over this action pursuant to FLA. STAT. §26.012(2)(g). GENERAL ALLEGATIONS 6. Since June 16, 2016, Plaintiff has owned the property located at 5101 Biscayne Blvd., Miami, Florida 33137 (the "Property"), which is legally described as: Lot 17, Block 5, of BAYSHORE PLAZA UNIT NO. 4, according to the Plat thereof, as recorded in Plat Book 42, at Page 2, of the Public Records of Miami -Dade County, Florida. 7. Plaintiff is the owner of the Property by virtue of that certain Special Warranty Deed dated June 16, 2016 and recorded on June 20, 2016 at Book 301 ] 9, Pages 233-35, in the Public Records in and for the County. 8. On November 29, 2018, the City issued to Plaintiff a Notice of Violation ("NOV," attached hereto as Exhibit A) for several alleged violations of the City Code. 9. On March 14, 2019, the City's Code Enforcement Board issued a Final Administrative Enforcement Order finding that Plaintiff violated the City Code for: (1) failure to maintain the exterior of the Property; (2) failure to maintain the lot in a safe, clean condition by allowing accumulation of debris, trash or dense growth of grass; and (3) the existence of a permanent chain link fence. 10. The Final Administrative Order established a deadline of May 15, 2019 to achieve compliance and imposing an undefined daily fine thereafter. 11. On July 8, 2019, the Final Administrative Enforcement Order was recorded. A true and correct copy of the recorded Final Administrative Enforcement Order is attached as Exhibit 13. 12. The Plaintiff complied with all of the violations identified in the NOV and achieved compliance. Acknowledging that all violations had been cured, the City issued an Affidavit of 2 Compliance (attached hereto as Exhibit C) on February 7, 2024. 13. Section 2-817(d)(2) of the City's Code provides that mitigation is not available for properties that exceed 271 days to reach compliance except for the exceptions listed in subsection (d)(4) of the City's Code. 14. The City maintains that Plaintiff is not exempt under Section 2-817(d)(4) of the City's Code. 15. A lien in excess of $411,250.00 exists on the Property. 16. Before filing this cause of action, Plaintiff communicated with Defendant in an attempt to mitigate the fines and remove the lien on the Property to no avail. 17. All conditions precedent have been completed before the fling of this cause of action. COUNT I — QUIET TITLE (the Property) 18. This is an action to quiet title pursuant to FLA. STAT. §§65.021 and 65.061. 19. Plaintiff incorporates and realleges the allegations in paragraphs 1 through 17 are incorporated as if set forth fully herein. 20. The Order imposed a lien on the Property. 21. Defendant may claim an adverse interest in the Property by virtue of the aforementioned lien. 22. Defendant does not have a lawful or legitimate interest in the Property, and any interest in the Property, if any, is subordinate and inferior to the Plaintiffs right, title, and interest in the Property. 23. Plaintiff is authorized to bring an action to quiet title to the Property and to clear 3 any cloud on its title. See Section 65.031, Florida Statutes. 24. Plaintiff has a compelling interest in removing the cloud of title imposed by the Order and the lien because the title of the Property is currently unmarketable. WHEREFORE, the Plaintiff respectfully requests that this Court enter a judgment in its favor and against Defendant extinguishing any right or claim that Defendant may have in the Property, and removing any and all clouds on title to the Property, and quieting title in the Plaintiff, together with any and such further relief as this Court deems necessary to protect Plaintiff's rights and interests to the Property.
