HomeMy WebLinkAboutO-12433City of Miami Legislation Ordinance: 12433 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0156 Final Action Date: 11/13/2003 (4/5THS VOTE) AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "WEED AND SEED PROGRAM," AND APPROPRIATING FUNDS, IN THE AMOUNT OF $209,500, RECEIVED BY THE CITY AS A GRANT FROM THE DEPARTMENT OF JUSTICE, EXECUTIVE OFFICE FOR WEED AND SEED, THROUGH MIAMI/MIAMI-DADE WEED AND SEED, INC. TO BE USED BY THE DEPARTMENT OF POLICE FOR THE PREVENTION OF CRIME, DRUG ABUSE, GANG ACTIVITY AND TO IMPROVE THE QUALITY OF LIFE IN LITTLE HAITI AND UPPER EASTSIDE COMMUNITIES; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Department of Police has been awarded grant funds, in the amount of $209,500, from the Department of Justice, Executive Office for Weed and Seed, through Miami/Miami-Dade Weed and Seed, Inc., for the prevention of crime, drug abuse, gang activity, and to improve the quality of life in Little Haiti and Upper Eastside communities; and WHEREAS, no matching funds are required from the City of Miami for acceptance of said grant; and WHEREAS, any purchases associated with said funds shall comply with applicable City Code procurement requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following Special Revenue Fund is established and resources are appropriated as described herein: FUND TITLE: WEED AND SEED PROGRAM RESOURCES: MIAMI/MIAMI-DADE WEED AND SEED, INC. $209,500 APPROPRIATION: $209,500 City of Miami Page 1 of 2 File Id: 03-0156 (Version: 2) Printed On: 8/18/2016 File Number: 03-0156 Enactment Number: 12433 Section 3. The City Manager is authorized{1} to accept the grant award from Weed and Seed and to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. The use of said grant funds by the Department of Police for the prevention of crime, drug abuse, gang activity and to improve the quality of life in the Little Haiti and Upper Eastside Communties, is authorized. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 6. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance is declared to be an emergency measure on the grounds of necessity of the City of Miami to make the required and necessary payments to its employees and officers, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 8. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four -fifths (4/5ths) of the members of the Commission. Section 9. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar darys from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
