("COLLABORATIVE") FOR THE CONSTRUCTION OF TWO SINGLE FAMILY, OWNER -OCCUPIED HOMES, AFFORDABLE TO VERY LOW, LOW AND MODERATE -INCOME FAMILIES AND INDIVIDUALS, TO MODIFY THE TIME FRAMES TO: (1) COMMENCE CONSTRUCTION OF IMPROVEMENTS ON THE LOT LOCATED AT 3648 OAK AVENUE, MIAMI, FLORIDA, FROM SIX (6) MONTHS AS SET FORTH IN RESOLUTION NO. 03-427 TO TWELVE (12) MONTHS FROM THE DATE OF CLOSING, (2) COMPLETE CONSTRUCTION OF THE IMPROVEMENTS FROM TWENTY-FOUR (24) MONTHS FROM THE DATE OF COMMENCEMENT OF CONSTRUCTION TO TWENTY-FOUR (24) MONTHS FROM THE DATE OF CLOSING, AND (3) PROVIDE EVIDENCE THAT THE COLLABORATIVE HAS SECURED A BUYER OF THE IMPROVED PROPERTY AT 3648 OAK AVENUE, MIAMI, FLORIDA, WHO SATISFIES THE APPLICABLE AFFORDABLE HOUSING INCOME TEST REQUIREMENTS FROM PRIOR TO CLOSING TO PRIOR TO COMMENCEMENT OF CONSTRUCTION OF THE PROPERTY LOCATED AT 3648 OAK AVENUE, MIAMI, FLORIDA. WHEREAS, the City Commission, pursuant to Resolution No. 03-427, adopted May 8, 2003, (which amended Resolution No. 02-865, as amended by Resolution No. 02-1056) approved the conveyance of two (2) City -owned lots to Coconut Grove Collaborative, Inc.("Collaborative") for the construction of two single-family, owner -occupied homes, affordable to very low, low and/or moderate -income families and/or individuals on City -owned real property located at 3658 Frow Avenue, Miami, Florida, and 3648 Oak Avenue, Miami, Florida; and WHEREAS, the closing of the sale of the properties to the Collaborative is scheduled for November 14, 2003; and WHEREAS, there appears to be a title defect affecting the property located at 3648 Oak Avenue, Miami, Florida ("Property"), more particularly described in "Exhibit A," attached and incorporated ; and WHEREAS, the Collaborative wishes to close the purchase of the Property notwithstanding the title defect provided that the City of Miami ("City") extends the period of commencement of City of Miami Page 1 of 2 File Id: 03-0262 (Version: 2) Printed On: 8/19/2016 File Number: 03-0262 Enactment Number: R-03-11 77 construction of improvements on the Property from six (6) months after the date of closing, as set forth in Resolution No. 03-427, to twelve (12) months after the date of closing; and WHEREAS, the Collaborative has agreed that notwithstanding the extended date for commencement of construction on the Property it will complete construction within 24 months after closing instead of 24 months from the date of commencement of construction, as contemplated in Resolution 03-427; and WHEREAS, due to the title defect, the Collaborative has further requested that it be permitted to submit evidence that it has secured a qualified buyer prior to commencement of construction, as opposed to, prior to closing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 02-865, as amended by Resolutions Nos. 02-1056 and 03-427, authorizing the conveyance of the City -owned properties located at 3658 FrowAvenue and 3648 Oak Avenue to the Coconut Grove Collaborative, Inc. ("Collaborative"), for the construction of two single family, owner -occupied homes, affordable to very low, low and moderate -income families and individuals, is amended to modify the time frames to: (1) commence construction of the lot located at 3648 Oak Avenue, Miami, Florida, from six (6) months from the date of closing, as set forth in Resolution No. 03-0427, to twelve (12) months from the date of closing, (2) complete construction of the improvements from twenty-four (24) months from the date of commencement of construction to twenty-four (24) months from the date of closing; and (3) provide evidence that the Collaborative has secured a buyer of the improved property at 3648 Oak Avenue, Miami, Florida, who satisfies the applicable affordable housing income test requirements from prior to closing to prior to commencement of construction of the property located at 3648 Oak Avenue, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
