HomeMy WebLinkAboutcover memo -111 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : FROM The Honorable May and Members ofth City Commi Joe rriola Chi f Administrator/City Manager DATE: SUBJECT: REFERENCES: ENCLOSURES: PH.4 Public Hearing OCT 3 0 2003 FILE : Resolution Granting Easement to Florida Power & Light Company — Melreese Golf Course City Commission Agenda November 13, 2003 RECOMMENDATION: The administration recommends that the City Commission adopt the attached Resolution, in substantially the attached form, for a Grant of Easement to Florida Power & Light Company ("FPL"), on City -owned property at the Melreese Golf Course, located at 1400 Northwest 37i1' Avenue, Miami, Florida, as more particularly described in Exhibit "A", attached hereto and made a part hereof, for the construction, operation and maintenance of overhead and underground electric utility facilities to service exclusively City -owned property, with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as, the size of and remove such facilities or any of them within the easement. This Resolution further authorizes the City Manager to execute a Grant of Easement to FPL, subject to Bunkers of Miami, a Florida Joint Venture, executing a joinder to this Easement. BACKGROUND: The State of Florida Department of Transportation ("FDOT") is planning to expand the access ramps along Le Jeune Road near Miami International Airport as part of the proposed construction of the Miami Intermodal Center. FDOT has requested that all utilities in conflict with their proposed construction, be relocated prior to the commencement of construction. Florida Power & Light Company has requested that they be granted an easement from the City of Miami ("City") in order to relocate utility facilities that service only Melreese Golf Course and adjacent City - owned property as needed. FPL shall, at its sole cost and expense, construct, operate and maintain overhead and underground electric utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be installed from time to time; with the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement, with full right of ingress thereto and egress therefrom. In the event this easement is disconnected or abandoned, the easement will cease and revert to the City.
