HomeMy WebLinkAboutR-03-1126City of Miami Legislation Resolution: R-03-1126 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0104 Final Action Date: 10/23/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO SEEK INJUNCTIVE RELIEF, OR ANY OTHER ACTIONS IN LAW OR IN EQUITY, TO ENSURE CITY CODE COMPLIANCE OF THE VIOLATIONS RELATED TO RECREATIONAL EQUIPMENT/MOBILE TRAILER AND A CARPORT WHICH ENCROACH INTO THE REQUIRED SETBACK OF THE PROPERTY LOCATED AT 2197 SOUTHWEST 10TH STREET, MIAMI, FLORIDA, SO LONG AS THERE EXISTS INADEQUATE REMEDIES AT LAW AND THE LIKELIHOOD OF IRREPARABLE INJURY WILL OCCUR IF THE INJUNCTION IS NOT GRANTED; FURTHER AUTHORIZING THE CITY ATTORNEY TO INITIATE FORECLOSURE ACTION AGAINST THE PROPERTY AT 2197 SOUTHWEST 10TH STREET, MIAMI, FLORIDA, FOR ANY OUTSTANDING LIENS RELATED TO CODE ENFORCEMENT OR COSTS RELATED TO THESE VIOLATIONS, PURSUANT TO APPLICABLE LAW. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is authorized{1} to seek injunctive relief or any other action in law or in equity, to ensure City Code compliance of the violations related to recreational equipment/mobile trailer and a carport which encroach into the required setback of the property located at 2197 Southwest 10th Street, Miami, Florida, so long as there exists inadequate remedies at law and the likelihood of irreparable injury will occur if the injunction is not granted. Section 2. The City Attorney is further authorized to initiate foreclosure action against the property at 2197 Southwest 10th Street, Miami, Florida for any outstanding liens related to Code enforcement or costs related to these violations, pursuant to applicable law. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: City of Miami Page 1 of 2 File Id: 03-0104 (Version: 2) Printed On: 8/17/2016 File Number: 03-0104 Enactment Number: R-03-1126 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
