HomeMy WebLinkAboutR-03-1124City of Miami Legislation Resolution: R-03-1124 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 03-0102 Final Action Date: 10/23/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A CONTRIBUTION OF FUNDS, IN THE AMOUNT OF $1,000,000, FROM THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT ("DISTRICT") TO PROVIDE FINANCIAL ASSISTANCE ON A REIMBURSEMENT BASIS FOR PHASES IV AND V OF THE WAGNER CREEK DREDGING PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") has appropriated funds and initiated engineering and permitting processes for the dredging and cleanup Wagner Creek, currently designated as Phases IV and V in the Capital Improvements Program, Project Numbers 352259 and 352263, respectively; and WHEREAS, the Projects consist of the design, permitting and implementation of dredging and disposal of sediment material along approximately 4,400 linear feet of Wagner Creek, from approximately Northwest 11th to 15th Streets, Miami, Florida, as well as the removal of debris and exotic trees along the creek and its banks; and WHEREAS, during the course of permitting for this work, soil, water and sediment samples were taken to characterize the project and to determine handling and disposal requirements for the sediment; and WHEREAS, these and subsequent test results identified the presence of contaminants, including dioxin/furan compounds, heavy metals, and pesticides, in concentrations generally above target threshold levels; and WHEREAS, these findings have changed the priority, purpose and scope of the project, and will further result in a significantly higher cost for the project; and WHEREAS, because the implementation of this project will improve water quality and habitat within Wagner Creek and within the adjoining water bodies, Seybold Canal, Miami River and Biscayne Bay, the District has offered financial assistance to the City in the amount of $1,000,000; City of Miami Page 1 of 3 File Id: 03-0102 (Version: 2) Printed On: 8/18/2016 File Number: 03-0102 Enactment Number: R-03-1124 and WHEREAS, the attached Agreement provides terms and conditions for use of District funds and reimbursement to City by District; and WHEREAS, the District has programmed funds into its Fiscal Year 2003-2004 Operating Budget for this purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to accept a contribution of funds, in the amount of $1,000,000, from the District providing financial assistance, on a reimbursement basis, for Phases IV and V OF the Wagner Creek Dredging Project. Section 3. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the District for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miami Page 2 of 3 File Id: 03-0102 (Version: 2) Printed On: 8/18/2016 File Number: 03-0102 Enactment Number: R-03-1124 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
