A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A NON-EXCLUSIVE GRANT
OF EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
BELLSOUTH TELECOMMUNICATIONS, INC., FOR THE SUM OF $30,000, FOR
PLACEMENT OF A REMOTE TERMINAL CABINET AND A SMALL POWER
METER BOX ON APPROXIMATELY 1,022 SQUARE FEET, AS DEPICTED IN
"EXHIBIT A," ATTACHED AND INCORPORATED, ON MERRIE CHRISTMAS
PARK, LOCATED AT APPROXIMATELY 3840 SOUTHWEST
37TH AVENUE, MIAMI, FLORIDA, TO PROVIDE ADDITIONAL SERVICE NEEDS
AT THREE LARGE TELEPHONE SERVICE AREAS, BORDERING LEJEUNE
ROAD ON THE WEST, WOOD AVENUE ON THE NORTH, SUNRISE AVENUE
ON THE SOUTH AND EAST TO BISCAYNE BAY.
WHEREAS, BellSouth Telecommunications, Inc. ("BellSouth"), a Georgia Corporation,
proposes placement of a remote terminal cabinet on Merrie Christmas Park located at
approximately 3840 Southwest 37th Avenue, Miami, Florida, to provide additional service needs at
three large telephone service areas bordering Lejeune Road on the west, Wood Avenue on the
north, Sunrise Avenue on the south and east to Biscayne Bay ; and
WHEREAS, the cabinet will provide additional feeder cable relief and improved transmission
quality for new service technologies such as DSL (High Speed Internet Service) which are in high
demand by residents and customers living and working from home; and
WHEREAS, the cabinet is made of aluminum measuring 112 inches wide, 46 inches deep and
72 inches high mounted on a concrete pad; and
WHEREAS, a small power meter box will also be located in the proposed easement next to the
cabinet; and
WHEREAS, BellSouth has agreed to pay the City of Miami ("City") $30,000 to supplement
various Park Programs; and
WHEREAS, BellSouth has also agreed to replace the damaged fence along the east side of
the Park; and
WHEREAS, the cabinet and the power meter box will be fenced in, and landscaping will be
provided to conceal the equipment as much as possible; and
WHEREAS, the easement shall contain a reverter provision that if the easement shall be
abandoned or discontinued, the easement shall cease and revert back to the City;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a non-exclusive Grant of
Easement, in substantially the attached form, with BellSouth, for the sum of $30,000, for
placement of a remote terminal cabinet and a small power meter box on approximately 1,022
square feet as depicted in "Exhibit A," attached and incorporated, on Merrie Christmas Park,
located at 3840 Southwest 37th Avenue, Miami, Florida, to provide additional service needs at
three large telephone service areas bordering Lejeune Road on the west, Wood Avenue on the
north, Sunrise Avenue on the south and east to Biscayne Bay .
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
