Resolution Granting a Non -Exclusive
Easement to BellSouth on
Merrie Christmas Park
Grant of Easement
RECOMMENDATION:
The administration recommends that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a non-exclusive Grant of Easement, in substantially the
attached form, on Merrie Christmas Park, located at approximately 3840 SW 37 Avenue, to
BellSouth Telecommunications, Inc. a Georgia Corporation ("BellSouth"), granting a non-
exclusive easement, for the sum of Twenty Thousand Dollars ($20,000.00), containing
approximately 1,022 square feet as depicted in Exhibit "A" attached hereto and made a part
hereof (the "Property") for placement of a remote terminal cabinet and a small power meter box
that will provide for additional service needs at three large telephone service areas.
BACKGROUND:
BellSouth Telecommunications, Inc. a Georgia Corporation ("BellSouth") proposes placement of
a remote terminal cabinet that will provide for additional service needs at three large telephone
service areas bordering Lejeune Road on the west, Wood Avenue on the north, Sunrise Avenue
on the south and east all the way to Biscayne Bay.
The cabinet's purpose is for additional feeder cable relief and improved transmission quality for
new service technologies such as DSL (high Speed Internet Service). These services are in high
demand by the residents and customers living and working from home in these areas. The
cabinet is made of aluminum measuring 112 inches wide, 46 inches deep and 72 inches high
mounted on a concrete pad. Alongside the cabinet will be a small power meter box. The cabinet
and meter box will be located in the proposed easement on City -owned park property (see
attached sketch).

In consideration, BellSouth has agreed to pay Twenty Thousand Dollars ($20,000.00) in order to
supplement the parks programs. They have also agreed to replace the damaged fence along the
east side of the park. A fence will also be placed around the easement to enclose the cabinet and
cross -box. Landscaping will be placed in such a manner that will essentially conceal the cabinets
as much as possible. This easement shall further contain a reverter provision that if the easement
shall be abandoned or discontinued, the easement shall cease and revert back to the City.
FINANCIAL IMPACT
There is o negative financial impact to the general fund.
