RE: Proposed Resolution for City Commission Meeting — October 23, 2003
Continued engagement of the law firm of Akerman, Senterfitt & Eidson,
P.A. for representation of City of Miami in the case of Young vs. City of
Miami, et al., in the U.S. District Court for the Southern District of
Florida, Case No. 99-2994-Civ-Jordan (File ID# 03-0148).
The attached proposed Resolution seeks authorization for continued engagement of
the law firm of Akerman, Senterfitt & Eidson, P.A. for representation of the City of
Miami only in the case of Young vs. City of Miami, et al., in the U.S. District Court for
the Southern District of Florida, Case No. 99-2994-Civ-Jordan, in the amount of
$50,000 plus costs as approved by the City Attorney.
As a result of the indictments of several of the officers names as defendants in these
cases, coupled with the guilty pleas of two of the named defendants, the City Attorney's
Office is ethically prohibited from representation of any defendant in this lawsuit,
including the City.
Resolution No. 01-1300, adopted December 13, 2001, allocated $100,000, plus
costs as approved by the City Attorney for this case. Approval of this Resolution will
bring the total amount allocated to $150,000.
Funds will be allocated from the City of Miami Self -Insurance and Insurance Trust
Fund, Index Code No. 515001.624401.6.652.
