RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Ordinance
amending Chapter 54 of the Code of the City of Miami entitled "Streets and Sidewalks"
by amending Section 54-190 entitled "Nonstandard Street Widths".
BACKGROUND
In 1937, Ordinance No. 20162 was adopted increasing the zoned right of way width of
NW 3 Street between NW 17 Avenue and NW 22 Avenue from the original platted 50-
foot width to 70 feet wide. In response to recent residential construction activity along
NW 3 Street, the Public Works Division has conducted an investigation to determine if
the reservation of the additional right of way width beyond the standard 50-foot wide
right of way is necessary to support development along this roadway.
The property abutting this portion of NW 3 Street is zoned "R-2" and is developed with
single family and duplex dwellings. The majority of the reserved right of way beyond the
50-foot width has not been dedicated for street purposes. For this reason, Public Works'
review of this transportation corridor reveals that the original platted 50 feet of right of
way width adequately serves the transportation needs of the public and the reservation of
a 70 foot wide right of way width is not necessary and creates a hardship for the
maintenance of the existing developed properties along NW 3 Street due to increased set-
back depth. The properties along the south side of NW 3 Street between NW 17 Place
and NW 19 Avenue must still make a reduced amount of additional right of way
dedication to conform to the standard 50 foot wide right of way and this portion of the
roadway will eventually be widened to match the existing conditions east of NW 17 Place
and west of NW 19 Avenue.
