A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
DECLARING A PUBLIC NEED FOR USE OF SEVEN RIGHTS -OF -WAY
PARCELS OF INTERSTATE HIGHWAY 395, OWNED BY THE FLORIDA
DEPARTMENT OF TRANSPORTATION ("FDOT") FOR THE OPERATION BY THE
DEPARTMENT OF OFF-STREET PARKING AS A PUBLIC PARKING LOT;
AUTHORIZING THE EXECUTIVE DIRECTOR OF THE DEPARTMENT OF
OFF-STREET PARKING'S ("DOSP") EXECUTION OF THE AIRSPACE
AGREEMENTS, AND ADDENDUMS TO THE AIRSPACE AGREEMENTS, IN
SUBSTANTIALLY THE ATTACHED FORMS, BETWEEN DOSP AND FDOT, FOR
THE LEASE OF THE SEVEN PARCELS, AS SET FORTH IN THE ATTACHED
AGREEMENTS AND ADDENDUMS.
WHEREAS, the Miami City Commission has determined that there is a public need for
additional public purpose parking lots on the following Florida Department of Transportation
("FDOT") rights -of -way located adjacent to Interstate Highway 395: Parcel No. 6001 (MPA
Parcel/Lot 1), Parcel No. 6006 (MPA Parcel/Lot 2), Parcel No. 6005 (MPA Parcel/Lot 3), Parcel
No. 6004 (MPA Parcel/Lot 4), Parcel No. 6007 (MPA Parcel/Lot 5), Parcel No. 6002 (MPA
Parcel/Lot 6), Parcel No. 6008 (MPA Parcel/Lot 7); and
WHEREAS, the Department of Off -Street Parking ("DOSP"), an agency and instrumentality of
the City of Miami, exercises supervisory control over the operation of off-street parking facilities in
the City; and
WHEREAS, FDOT may convey a leasehold in the name of the State for any property acquired
under Section 337.25, Florida Statutes; and
WHEREAS, FDOT acquired legal title, right and interest in the rights of way of Interstate
Highway 395, specifically the seven (7) properties referenced herein; and
WHEREAS, DOSP wishes to enter in an Airspace Agreement and an Addendum to the
Airspace Agreement with FDOT for each of the seven referenced FDOT parcels for the operation
of a public parking lot, to be available to the public at all times; and
WHEREAS, the Off -Street Parking Board has favorably reviewed and approved the Airspace
Agreements and Addendums to Airspace Agreements for said parcels, and has approved the
execution of these documents by the Executive Director of DOSP; and
WHEREAS, it is appropriate for the City Commission to declare that such parking lots are a
public need;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The use of the following seven rights -of -way parcels of Interstate Highway 395,
owned by FDOT for the operation of a public parking lot by the Department of Off -Street Parking,
available to the public at all times, are declared to be a public need:
Parcel No. 6001 (MPA Parcel/Lot 1)
Parcel No. 6006 (MPA Parcel/Lot 2)
Parcel No. 6005 (MPA Parcel/Lot 3)
Parcel No. 6004 (MPA Parcel/Lot 4)
Parcel No. 6007 (MPA Parcel/Lot 5)
Parcel No. 6002 (MPA Parcel/Lot 6)
Parcel No. 6008 (MPA Parcel/Lot 7).
Section 2. The Executive Director of the Department of Off -Street Parking's execution of
seven Airspace Agreements and Addendums to Lease Agreements, in substantially the attached
form, for the parcels listed in Section 2 herein is authorized.{1}
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor {2}.
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
