A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A UNITY OF TITLE, IN
SUBSTANTIALLY THE ATTACHED FORM, RESTRICTING THE USE OF
SEVERAL CITY OF MIAMI O)'VNED PARCELS OF LAND, LOCATED AT GIBSON
PARK LOCATED AT 404 NORTHWEST 14TH STREET, 411 NORTHWEST 11TH
STREET, 1360 NORTHWEST 3RD AVENUE, 308 NORTHWEST 14TH STREET,
450 NORTHWEST 14TH STREET, 380 NORTHWEST 14TH STREET, 339
NORTHWEST 13 STREET, 1208 NORTHWEST 3RD AVENUE, 1200
NORTHWEST 3RD AVENUE, 1240 NORTHWEST 3RD AVENUE, 350
NORTHWEST 13TH STREET AND 1338 NORTHWEST 3RD AVENUE, MIAMI,
.FLORIDA, MORE PARTICULARLY DESCRIBED IN "EXHIBIT A", ATTACHED
AND INCORPORATED, WITH TERMS AND CONDITIONS AS MORE
PARTICULARLY SET FORTH IN SAID UNITY OF TITLE; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY
DOCUMENTS FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") has established a Capital Improvement Project to design
and construct a new recreational building and other park amenities at Gibson Park; and
WHEREAS, said project has been incorporated into the City's Capital Improvement Program
and Multi-year Plan as Project No. B -30305B, entitled "Gibson Park New Construction" ("Project"); and
WHEREAS, the City conducted a competitive selection process, and issued a Request For
Proposals No. 08-09-064, for Design Build Services for the Design and Construction of Gibson Park;
and
WHEREAS, pursuant to Resolution No. 10-0103, adopted March 11, 2010, the City
Commission awarded a contract to Recreational Design and Construction, Inc. for the Project; and
WHEREAS, the City is the owner of several parcels of real property located in Miami -Dade
County, Florida and more particularly described in "Exhibit A", attached and incorporated; and
WHEREAS, the City desires to unite these parcels in order to obtain construction permits
necessary for the construction of the Project; and
WHEREAS, in order to obtain the necessary approvals from the Planning Department, Zoning
Department and the Building Department ("Departments") and other permitting agencies to connect
these parcels as a one site, the execution of a Unity of Title is required and shall be filed as a
permanent part of public property records in the Miami -Dade County; and
WHEREAS, execution of the attached Unity of Title will satisfy the Departments' requirements
by placing limitations on the land encompassing the building site; and

WHEREAS, the Unity of Title shall remain in full force and effect until such time as the same
may be released in writing by the Director of the Planning Department and/or the Zoning Administrator;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a Unity of Title, in substantially the attached
form, restricting the use of several City -owned parcels of land located at Gibson Park, 404 Northwest
14th Street, 411 Northwest 11th Street, 1360 Northwest 3rd Avenue, 308 Northwest 14th Street, 450
Northwest 14th Street, 380 Northwest 14th Street, 339 Northwest 13 Street, 1208 Northwest 3rd
Avenue, 1200 Northwest 3rd Avenue, 1240 Northwest 3rd Avenue, 350 Northwest 13th Street and
1338 Northwest 3rd Avenue, Miami, Florida, as described in "Exhibit A", attached and incorporated,
with terms and conditions as more particularly set forth in said Unity of Title.
Section 3. The City Manager is further authorized{1} to execute all necessary documents for
said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
