A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE THE ASSISTANCE
AMENDMENT TO THE EXISTING ASSISTANCE AGREEMENT BETWEEN THE
CITY OF MIAMI ("CITY") AND THE UNITED STATES ENVIRONMENTAL
PROTECTION AGENCY, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE
CITY'S PARTICIPATION IN THE NATIONAL CLEAN DIESEL FUNDING
ASSISTANCE PROGRAM ("PROGRAM"); FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ANY ADDITIONAL DOCUMENTS NECESSARY FOR THE
ADMINISTRATION OF THE PROGRAM.
WHEREAS, on September 24, 2009, the Miami City Commission adopted Resolution No. 09-0436
authorizing the City of Miami ("City") to enter into an Assistance Agreement ("Agreement") with the
United States Environmental Protection Agency ("EPA") for the City's participation in the national
clean diesel funding assistance program ("Program"); and
WHEREAS, the parties entered into the Agreement effective June 1, 2009; and
WHEREAS, the City submitted a request to the EPA to extend the current end date of the
Agreement between the parties; and
WHEREAS, on September 1, 2010, the EPA notified the City that its request was granted; and
WHEREAS, the Assistance Amendment ("Amendment") will extend the end date of the
Agreement from September 30, 2010 to June 30, 2011, thereby providing the City the additional time
it requires to perform its obligations under the Agreement; and
WHEREAS, it is in the best interest of the City to amend the Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1 } to execute the Assistance Amendment to the
existing Assistance Agreement between the City and the EPA, in substantially the attached form, for
the City's participation in the Program.
Section 3. The City Manager is further authorized {1 )to execute additional documents necessary
for the administration of the Program.

Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
