HomeMy WebLinkAboutLegislation�f.,,'\. ?�y; City of Miami City Hall 3500 Pan American _ ��t st- Drive rti�;f LegislationMiami, FL 33133 wvvw.miamigov.com Resolution File Number: 10-01110 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE DE -OBLIGATION OF COMMUNITY DEVELOPMENT BLOCK GRANT ('CDBG") FUNDS, IN THE TOTAL AMOUNT OF FOUR HUNDRED AND THIRTY THOUSAND, EIGHT HUNDRED DOLLARS ($430,800), FROM THE ENTITIES LISTED IN EXHIBIT "A", ATTACHED AND INCORPORATED; AUTHORIZING THE GRANT AWARD OF AN AMOUNT NOT TO EXCEED FOUR HUNDRED AND THIRTY THOUSAND, EIGHT HUNDRED DOLLARS ($430,800) AND THE TRANSFER OF SAID NOT TO EXCEED AMOUNT OF SAID CDBG FUNDS, UNDER CERTAIN TERMS AND CONDITIONS IN A SPECIAL GRANT AGREEMENT, TO RAFAEL HERNANDEZ HOUSING AND ECONOMIC DEVELOPMENT CORPORATION ("RHHED"), FOR ECONOMIC DEVELOPMENT ACTIVITIES TO CONTINUE THE REHABILITATION OF COMMERCIAL BUILDINGS IN THE NORTHEAST 2ND AVENUE CORRIDOR IN THE CITY OF MIAMI LITTLE HAITI NEIGHBORHOOD; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, A SPECIAL GRANT AGREEMENT WITH RHHED AND ALL OTHER NECESSARY DOCUMENT(S) FOR SAID PURPOSE(S). WHEREAS, Rafael Hernandez Housing and Economic Development Corporation ("RHHED") is a non-profit corporation previously selected pursuant to a competitive bid process to participate in economic development activities for commercial rehabilitation projects in the City of Miami ("City") in Districts 2 and 5; and . WHEREAS, the City desires to continue the commercial rehabilitation projects for the fagade rehabilitation of businesses located along Northeast 2nd Avenue in the Little Haiti Neighborhood which include installing new windows, doors, awnings, signs, and shutters; painting; carpentry work; and architectural design; and . WHEREAS, RHHED has previously successfully completed commercial rehabilitation projects for the City in the Northeast 2nd Avenue corridor and the City's Department of Community Development is recommending that RHHED continue to provide such services and to enter into a negotiated special grant agreement with the City for said purposes; and WHEREAS, it is recommended that RHHED be compensated at a rate of fifteen percent (15%) of the individual project cost for each commercial rehabilitation project, but in an amount not to exceed sixty-four thousand, six hundred and twenty dollars ($64,620) per project, for overseeing and managing the commercial rehabilitation projects along Northeast 2nd Avenue; and WHEREAS, property owners will be required to sign a 5 year covenant restricting the use of the property to ensure compliance with federal regulations; and WHEREAS, the Administration recommends the de -obligation of Community Development Block City of Miami Page I of 2 File Id: 10-01110 (Version: 1) Printed On: 10/1/2010 File Number: 10-01110 Grant ("CDBG") funds, in the amount of four hundred thirty thousand, eight hundred dollars ($430,800), from the entities listed in Exhibit "A", attached and incorporated, and the award and transfer of said CDBG funds, under certain terms and conditions in a special grant agreement, to RHHED for Economic Development Activities to continue the rehabilitation of commercial buildings in the Northeast 2nd Avenue corridor in the City's Little Haiti Neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The de -obligation of CDBG funds, in the total amount of four hundred and thirty thousand, eight hundred dollars ($430,800), from the entities listed in Exhibit "A", attached and incorporated, is authorized. Section 3. The grant award of an amount not to exceed four hundred and thirty thousand, eight hundred dollars ($430,800) and the transfer of said not to exceed amount of said CDBG funds, under certain terms and conditions in a special grant agreement, to RHHED, for economic development activities to continue the rehabilitation of commercial buildings in the Northeast 2nd Avenue corridor in the City's Little Haiti Neighborhood, are authorized. Section 4. The City Manager is authorized{1} to negotiate and to execute, after consultation with the City Attorney, a special grant agreement with RHHED and all other necessary documents for said purposes. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS:!� JULIE O. BRU �dp CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
