HomeMy WebLinkAboutR-10-0440Vop City of Miami Legislation < U R �O Resolution: R-10-0440 File Number: 10-01105 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/14/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT FOR FISCAL YEAR 2010-2011 ENTITLED: "CHILD DAY CARE FOOD PROGRAM" AND APPROPRIATING FUNDS IN THE ESTIMATED AMOUNT OF EIGHTY THOUSAND DOLLARS ($80,000), CONSISTING OF ENTITLEMENT FUNDING ON A REIMBURSEMENT BASIS FROM THE FLORIDA DEPARTMENT OF HEALTH BUREAU OF CHILD NUTRITION PROGRAMS CHILD CARE FOOD PROGRAM ADMINISTERING FUNDS FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE CHILD AND ADULT CARE FOOD PROGRAM (CFDA# 10.558); AUTHORIZING THE CITY MANAGER TO ACCEPT SUCH ENTITLEMENT FUNDING ON A REIMBURSEMENT BASIS AND TO EXECUTE THE FISCAL YEAR 2010-2011 CONTRACT (INCLUDING ALL ATTACHMENTS AND AMENDMENTS THERETO, COLLECTIVELY THE "FISCAL YEAR 2010-2011 CONTRACT"), IN SUBSTANTIALLY THE ATTACHED FORM, AND TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, ALL OTHER NECESSARY DOCUMENTS FOR COMPLIANCE WITH AND OPERATIONS OF A YEAR-ROUND FOOD SERVICE PROGRAM (THE "PROGRAM") FOR PRESCHOOLAGED CHILDREN IN THE CITY OF MIAMI PARKS, WITH CONDITIONS AS STATED HEREIN; AUTHORIZING THE EXPENDITURE OF THE ENTITLEMENT FUNDS FOR THE OPERATIONS OF THE PROGRAM, WITH SUCH AUTHORIZATION REMAINING VALID AND OUTSTANDING EVEN IF THE ANTICIPATED ENTITLEMENT AWARD IS REDUCED OR INCREASED. WHEREAS, the City of Miami's ("City") Department of Parks and Recreation, Day Care Division sponsors a year-round Food Service Program (the "Program") for preschool -aged children which provides nutritional meals as a part of its child day care services programs in City parks; and WHEREAS, the Florida Department of Health ("DOH"), Bureau of Child Nutrition Programs Child Care Food Program funded by the United States Department of Agriculture ("USDA") Child and Adult Care Food Program (CFDA# 10.558), provides entitlement funding to the City to conduct the Program from October 1, 2010 through September 20, 2011 for preschool aged children; and WHEREAS, said entitlement funding is payable on a reimbursement basis in the estimated amount of eighty thousand dollars ($80,000) and is based on year 2009 figures and reimbursement rates and may be later adjusted by the USDA and/or DOH; and WHEREAS, the USDA and the DOH have provided the form of Fiscal Year 2010-2011 Contract with certain attachments and amendments thereto, (collectively "Fiscal Year 2010-2011 Contract"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miand Page 1 of 2 File Id. 10-01105 (Version: 1) Printed On: 8/10/2017 File Number: 10-01105 Enactment Number: R-10-0440 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Project for Fiscal Year 2010-2011 is hereby established and resources are hereby appropriated as described below: FUND TITLE: Child Day Care Food Program RESOURCES: United States Department of Agriculture Child and Adult Care Food Program (CFDA # 10.558) through the Florida Department of Health Bureau of Child Nutrition Programs Child Care Food Program $80,000 APPROPRIATION: $80,000 Section 3. The City Manager is authorized(1) to accept such entitlement funding on a reimbursement basis and to execute the Fiscal Year 2010-2011 Contract, in substantially the attached form, and to negotiate and to execute, after consultation with the City Attorney, all other necessary documents for compliance with and operations of a year-round Food Service Program (the "Program") for preschool aged children in the City's parks, with conditions as stated herein. Section 4. The expenditure of the entitlement funds is authorized for the operations of the Program, with such authorization remaining valid and outstanding even if the anticipated entitlement award is reduced or increased. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
