A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT A REIMBURSEMENT GRANT, IN
AN AMOUNT NOT TO EXCEED FORTY-EIGHT THOUSAND DOLLARS ($48,000)
("REIMBURSEMENT GRANT"), FROM MIAMI-DADE METROPOLITAN PLANNING
ORGANIZATION ("MPO"); AUTHORIZING THE CITY OF MIAMI ("CITY") TO
PROVIDE MATCHING FUNDS FOR THE REIMBURSEMENT GRANT, IN AN
AMOUNT NOT TO EXCEED TWELVE THOUSAND DOLLARS ($12,000) ("CITY'S
MATCHING FUNDS"), FOR THE PREPARATION OF A HEALTH DISTRICT BICYCLE
AND PEDESTRIAN MOBILITY STUDY ("STUDY"); ESTABLISHING A NEW SPECIAL
REVENUE PROJECT FOR FISCAL YEAR 2010-2011 ENTITLED: "HEALTH
DISTRICT BICYCLE AND PEDESTRIAN MOBILITY STUDY" AND APPROPRIATING
FUNDS NOT TO EXCEED THE AMOUNT OF FORTY-EIGHT THOUSAND
DOLLARS ($48,000), FROM THE REIMBURSEMENT GRANT AND FUNDS NOT TO
EXCEED THE AMOUNT OF TWELVE THOUSAND DOLLARS ($12,000), FROM
THE CITY'S MATCHING FUNDS; FURTHER AUTHORIZING THE CITY MANAGER
TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY
ATTORNEY, THE INTERLOCAL AGREEMENT WITH MPO ("INTERLOCAL
AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, AND TO NEGOTIATE
AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, ALL
OTHER NECESSARY DOCUMENTS FOR COMPLIANCE WITH AND
IMPLEMENTATION OF THE REIMBURSEMENT GRANT AND TO UNDERTAKE THE
STUDY WITH THE ASSISTANCE OF HNTB CORPORATION, WITH CONDITIONS
AS STATED HEREIN; AUTHORIZING THE EXPENDITURES OF THE
REIMBURSEMENT GRANT FUNDS AND THE CITY'S MATCHING FUNDS FOR
COMPLIANCE WITH THE INTERLOCAL AGREEMENT AND IMPLEMENTATION OF
THE STUDY, WITH SUCH AUTHORIZATION REMAINING VALID AND
OUTSTANDING EVEN IF THE ANTICIPATED REIMBURSEMENT GRANT AWARD
IS REDUCED OR INCREASED.
WHEREAS, the City of Miami ("City") applied for and has been awarded a reimbursement grant in
the not to exceed amount of forty-eight thousand dollars ($48,000) (the "Reimbursement Grant") from
the Miami -Dade Metropolitan Planning Organization ("MPO") under the Fiscal Year 2010-2011
Municipal Grant Program to assist in the preparation of a City Health District Bicycle and Pedestrian
Mobility Study (the "Study"); and
WHEREAS, the Reimbursement Grant requires a minimum City match of twenty percent (20%) or
twelve thousand dollars ($12,000), which has been identified from Capital Improvement Project No.
B -30645B (the "City Matching Funds"); and
WHEREAS, the City's Health District, as one of the densest urban areas in Miami -Dade County
with hospitals, educational institutions, judicial offices and housing, is ideally situated in what should
be a favorable pedestrian environment; and

WHEREAS, pedestrian and bicycle facilities enhance the use of public transportation and provide
reasonable alternatives to the personal car; and
WHEREAS, typically, areas with a comprehensive bicycle and pedestrian network also realize
less vehicular congestion, a reduction of pollution, and vibrant street activity that promotes a safe
community; and
WHEREAS, pedestrian and bicycle facilities are inadequate throughout the Health District and
lack marked crosswalks, directional signage, designated bicycle lanes, adequate signalization, and, in
some places, may need additional improvements to meet Americans with Disabilities Act ("ADA")
requirements; and
WHEREAS, the last comprehensive study of the pedestrian needs of the Health District was
conducted sixteen (16) years ago with the Civic Center Pedestrian Amenities and Safety Study,
submitted to the MPO by Barton-Aschman Associates, Inc. in 1994; and
WHEREAS, few of the 1994 study's suggestions have been implemented; however, the Health
District has experienced major development, increased employment, and an increased number of
daily visitors since 1994; and
WHEREAS, it is imperative to revisit the pedestrian and bicycle network in light of the
development and future plans for the Health District area; and
WHEREAS, the City Commission pursuant to Resolution No. 08-0610, adopted October 23, 2008,
has previously authorized and entered into a professional services agreement with HNTB Corporation
to provide various transportation program support services such as undertaking the proposed Study
for the Health District and to set forth the compensation arrangements for those support services; and
WHEREAS, in order to implement the Reimbursement Grant, provide the City's Matching Funds,
and permit HNTB Corporation to assist the City with the Study for the Health District, the City and
MPO are proposing to enter into an Interlocal Agreement (the "Interlocal Agreement") and such other
documents as may become necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to accept the Reimbursement Grant in an amount not
to exceed forty-eight thousand dollars ($48,000) from the MPO and to provide matching funds for the
Reimbursement Grant in an amount not to exceed twelve thousand dollars ($12,000) (the "City's
Matching Funds") for the preparation of the Study.
Section 3. The following Special Revenue Project for Fiscal Year 2010-2011 is hereby
established and resources are hereby appropriated as described below:

APPROPRIATIONS: $60,000
Section 4. The City Manager is further authorized {1} to negotiate and to execute, after
consultation with the City Attorney, the Interlocal Agreement, in substantially the attached form, and to
negotiate and to execute, after consultation with the City Attorney, all other necessary documents for
compliance with and implementation of the Reimbursement Grant and to undertake the Study with
the assistance of HNTB Corporation, with conditions as stated herein.
Section 5. The expenditures of the Reimbursement Grant funds and the City's Matching Funds for
compliance with the Interlocal Agreement and implementation of the Study are authorized, with such
authorization remaining valid and outstanding even if the anticipated Reimbursement Grant award is
reduced or increased.
Section 6. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
