WHEREAS, Chapter 10, Article 1 of the Code of the City of Miami, Florida, as amended ("Code"), provides the fee schedule for the processing and issuance of various building permits; and WHEREAS, currently the fees associated with Chapter 10, Article I of the Code do not sufficiently cover the actual cost of City of Miami ("City") staff to perform the processing and issuance of the permits contained therein; and WHEREAS, it is in the best interest of the City to amend Chapter 10 of the Code to increase the fees charged to perform the processing and issuance of the permits contained therein; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. (a) Fee for work without permit. The payment of such fees shall not relieve any person, firm, or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The fee requirement shall be applicable to all divisions of the building department. General fees, minimum fee. (1) Solid waste surcharge. a. (2) C. Building permits. Residential: $3-.24 $0.22 per $100.00 of the estimated cost of construction with a minimum fee of $26.00 and a maximum fee of $52.5.09 $600.00. Commercial: Permits for a building whose estimated construction cost is under $1,000,000.00: Two and a half percent of the cost of construction with a minimum of $53.99 $57.00 and a maximum of $10,500.00. Permits for a building whose estimated construction cost is equal to or over $1,000,000.00: Two percent of the cost of construction with a minimum of $54.08 $56.00 and a maximum of $4$509.09 $11,000.00. Master electrical, mechanical, and plumbing permits. Residential: $9.21 $0.22 per $100.00 of the cost of construction on all master electrical, mechanical and plumbing permits with a minimum fee of $26.00_128.00 and a maximum fee of $525.00 $550.00. Commercial: $4.24 $0.22 per $100.00 of the cost of construction on all master electrical, mechanical and plumbing permits with a minimum fee of $54.00 $57.00 and a maximum fee of Q'�-AA $2757.00. Exemptions: The following permits are exempt: sign, landscape, elevator, revisions, residential painting permits, subsidiary permits (i.e., permits issued under the master permit plan number), building roofing, awning, door, window, shed, floor covering and driveway. Affordable housing shall be exempt providing that proper certification from the director of the community development department is presented at the time plans are reviewed. Reinspection fees. For each reinspection, except where otherwise noted, $54-90 57.00, when extra inspection trips are necessary due to: a. b. C. d. e. The payment of reinspection fees may be required before any further permits will be issued to the person or firm owing same, and further inspections may be refused until payment of reinspection fees has been made. (3) Reinspection of existing buildings and inspection for certificate of compliance fee. The service will cover the following disciplines: building, structural, mechanical, plumbing, electrical, elevator and gas. Outside source review will be the preferred method. In-house review fee $263.98 276.00** **Fee is per discipline with a maximum of two reviews per fee per discipline. 9. Expedited plans review service for green buildings. Green buildings are defined as those with resource efficient design, construction, and operation by employing environmentally sensible construction practices, systems, and materials and defined as residential or commercial buildings that are registered Leadership in Energy and Environmental Design ("LEED") projects. LEED is defined as the most recent Leadership in Energy and Environmental Design Rating System of the U.S. Green Building Council. Expedited priority review of permit applications shall be defined as those to be reviewed prior to non -green building applications, in the order received, within the building permit review process. A refundable deposit, described in subsection i. will be required. h. Green buildings eligible for priority permitting will be: 1. 2. For buildings in excess of 50,000 square feet, and that exceed the requirements of LEED Silver certification. For buildings below 50,000 square feet, and that meet or exceed the requirements for any level of LEED certification. To qualify for expedited priority review and approval of permit applications, buildings meeting the criteria above must submit to the building department: 1. 2. 3. A LEED registration form; A LEED scorecard indicating all expected rating points; and The name and contact information for a LEED accredited professional on the project team. Dry run fee/upfront fee. No credit will be given if after review, a substantial new design is submitted for review, or a permit is not issued within 180 days of last review. No refunds will be allowed. Certificate of occupancy, temporary certificate of occupancy, certificate of use and temporary certificate of completion. (6.5) U Methods for placing bonds may be: i. Surety company issuance of bond. ii. Cash bond. Payable by cash, or certified cashier's check. A copy of signed contract with a contractor to do the work is also required. Letter of credit from a guaranteed insured state certified bank. The letter shall indicate the purpose of the line of credit. A copy of signed contract with a contractor to do the work is also required. If work is done within specified time, the city will proceed to have the work done (1) through the bonding company if Method No. i. was used; (2) through the contractor specified in the contract if Method No. ii. or Method No. iii. was used, using the proceeds from the cash bond or from the bank letter of credit. Occupation prior to obtaining certificate. When a building is occupied prior to obtaining a temporary or final certificate of occupancy, a fee double the certificate amount plus a $100.00 $105,00 fine shall be paid. The payment of such fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. Partial and/or temporary occupancy. Temporary certificate of use on partial and/or temporary occupancy $63-00 $100.00 Minimum permit fee required. The minimum permit fee shall be $63.00 $100.00. Provided, however, awning and shed permits shall be exempt from the minimum permit fee and shall also be exempt from payment of any public works, zoning and fire review fees set forth in this Code. This exemption is intended to supersede any sections to the contrary in this Code. (7) Violation notice. When a violation notice and/or notification letter is sent ordering correction of an existing violation, the following administrative fee is required to be paid, such payment being cumulative and in addition to any fines or penalties which may be imposed as a result of a conviction for said violation. Refunds, time limitation, revocation, etc. The fees charged pursuant to this section, provided the same are for a permit required by Section 301.1 of the Seth Florida Building Code, may be refunded by the director of the building and zoning department, subject to the following: (1) No refunds shall be made where any work has commenced except where duplicate permits are issued for the same work, in which case a refund in accordance with subsection (4), below, may be granted to the original permit holder providing that the duplicate permits were issued within 90 days of each other and request for refund is received within 90 days of the issuance of the latter permit. (2) No refunds shall be made where a permit has become void as provided by paragraph 304.3(a) of the Seth Florida Building Code. The second contractor shall pay a full fee to complete the work unless the first contractor waives his/her opportunity to refund in writing, or if the property owner can provide proof that the first permit holder was reimbursed for the permit fee, in which case the second contractor is entitled to a permit to cover the same work on a "no charge" basis. If the first payment is expired the second contractor shall pay a full permit fee on unstarted work or a completion permit fee in accordance with subsection (d) (16)b, below. A full refund may be granted to a permit holder who takes out a permit covering work outside the jurisdictional inspection area, or if permit is canceled by the department within 90 days with no work being done.
