Purpose of Item: An ordinance of the Miami City Commission amending Chapter 35 of the Code of the City of Miami, Florida, as amended, entitled "Motor Vehicles and Traffic," more particularly by creating Article XI, entitled "Commercial Vehicle Weight Restrictions," to provide for regulations on wheel and axle loads and vehicle weights to protect the public health, safety, and general welfare upon the city's roadways and to provide definitions; containing a repealer provision, a severability clause and providing for an immediate effective date. Director City Manager ATTACHMENT Overweight vehicles pose a danger to the City's residents and roadways. As defined per Florida State Statute 316.003(66), a commercial motor vehicle is any self-propelled or towed vehicle used on public highways in commerce to transport passengers or cargo. For the general welfare and safety of the public, the City desires to amend the City Code by providing for regulations on wheel and axle loads and gross vehicle weight or certain vehicles traveling upon the City's roadways. This ordinance is intended to give additional authority to the City's law enforcement officers to regulate said vehicles traveling within the City. Historically, the enforcement of weights, safety and hazardous material laws, rules and regulations in relation to commercial motor vehicles has mostly been the responsibility of the Department of Transportation's Motor Carrier Compliance Office. However, due to various reasons, several municipalities and sheriff's offices throughout the nation, as well as the state of Florida, have established commercial vehicle enforcement units within their respective organizations. It is in the best interest of the City to adopt the proposed amendment to the City Code, aimed at promoting the public health, safety and general welfare upon our streets, roadways and highways by regulating the wheel and axle loads and gross vehicle weights of commercial motor vehicles.
