AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
53/ARTICLE II, DIVISION II, OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
AS AMENDED, ENTITLED "STADIUMS AND CONVENTION CENTERS/CITY
STADIUMS/MARINE STADIUM", IN ORDER TO INCREASE FEES RELATED TO
THE USE OF THE PARKING LOT AND ESTABLISH A PROCESS FOR WAIVING
SUCH FEES; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 53-53 of the Code of the City of Miami, Florida, as amended ("Code"),
provides for the "Rental rates and associated charges and conditions" of the Marine Stadium; and
WHEREAS, the Code allows use of the Marine Stadium parking lot for a flat fee, payable in
advance, of $1,050 per day or portion thereof; and
WHEREAS, the fees associated with the use of the Marine Stadium parking lot do not provide
the City of Miami ("City") adequate return for its use; and
WHEREAS, it is in the best interest of the City to amend Chapter 53 of the Code to increase
said fees and establish a process for waiving such fees, when appropriate;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the preamble to this Ordinance are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Chapter 53/Article II/Division II of the Code, entitled "Stadiums and Convention
Centers/City Stadiums/Marine Stadium/Rental rates and associated charges and conditions" is
amended as follows:{1}

Sec. 53-53. Rental rates and associated charges and conditions.
(b) Admission tax and minimum charges.
(1) Except as otherwise provided in this section, charges by the city for the use
of the stadium shall be assessed as follows:
c. For the use of the parking lot only, there shall be assessed a flat fee,
payable in advance, of $1,050.99 peF day -the greater of $2,000.00 per day or
$15.00 per square foot or portion thereof. The $1,05G.00 flat fee This fee does
not include any stadium costs. All event costs, including but not limited to
electricity used, security, electricians, cleanup, police department personnel
required for traffic control and crowd control, etc., shall be paid by the user.
d. The fee required under this section may be waived for governmental entities
and agencies, or as approved by the city commission.
de. For the use of the stadium premises for a combination of several types
of events, the user shall pay those rates which apply to the event having the
larger of the fees quoted herein,
Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon final reading and adoption
thereof. {2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the

City Commission.
