Start Up Capital Cost: $0.00 Maintenance Cost: $0.00 Total Fiscal Impact: $150,000.00 Pavy 1 of CIP If using or receiving capital funds Grants Final Approvals (SIGN AND DATE) Budget_ Risk Purchasing_ Dept, Chief City Page 2 of 2 AGENDA SUMMARY FORM ATTACHMENT Subject: AN ORDINANCE OF THE MIAMI COMMISION AMENDING CHAPTER 22 OF THE CITY OF MIAMI CODE, AS AMENDED, ENTITLED "GARBAGE AND OTHER SOLID WASTE" MORE PARTICULARY AMENDING SECTIONS 22-1; 22-2; 22-6; 22-12; 22-14; 22-46; 22-47; 22-48; 22-49; 22-50; 22-53; 22-56; 22-57; 22-25; CREATING SECTIONS 22-19 TO 22-21, REQUIRING RECYCLING PROGRAMS FOR MULTI -FAMILY AND COMMERCIAL ESTABLISHMENTS; AND ALLOWING MODIFIED RECYCLING PROGRAMS Background Information: On September 28, 1999, Ordinance No. 11837 was passed by the Miami City Commission which amended Chapter 22, entitled Garbage and Other Solid Waste, of the City Code to allow regulatory permits for providing non-exclusive commercial solid waste services with commercial franchises to qualified firms. There are currently 15 commercial solid waste franchisees operating in the City and last fiscal year, remitted $10.8 million in fees. As permissible per Section 166.221, Florida Statutes, the department, with the assistance of GSA, will be instituting a yearly inspection of all vehicles that the franchisees use to conduct business of whatever source within the City boundaries. The annual inspection is anticipated to generate revenues in excess of $100,000. On October 15, 1991, Miami -Dade County (County) adopted Ordinance No. 91-123 which required the County and municipalities to establish commercial and multi -family recycling and the enforcement thereof In talking with the County's Solid Waste Management and reviewing cases that the County has cited within the City of Miami, enforcement of the ordinance has the potential to generate annual revenues in excess of $50,000. The proposed amendments_ and sections that are being created will primarily be used to regulate franchisees, institute a safety inspection program and regulate commercial waste collection.
