Vu A RESOLUTION OF TFIE CITY OF MIAMI CIVILIAN INVESTIGATIVE PANEL WITH ATTACHMENT(S), APPROVING FOR SUBMISSION TO THE MAYOR AND CITY COMMISSION A PROPOSED TOTAL ANNUAL BUDGET FOR TIIE CIVILIAN INVESTIGATIVE PANEL, IN TBE AMOUNT OF $464,000.00, FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2010 AND ENDING SEPTEMBER 3 0, 2011. WHEREAS, the City of Miami Civilian Investigative Panel ("CIP") serves as independent civilian oversight of the sworn police department with authority to, among other responsibilities and powers, conduct investigations of police misconduct complaints, review policies of the Department of Police and to issue subpoenas in connection with police misconduct investigations; and Whereas the CIP is required to annually submit to the City Commission a budget request pertaining to its functions; and WHEREAS, the CIP has approved a budget in the amount of $464,00.00 to conduct its primary functions for the Fiscal Year commencing October 1, 2010 and ending September 30, 2011; and NOW, THEREFORE, BE IT RESOLVED BY THE CIVILIAN INVESTIGATIVE PANEL THAT: Section 1. The proposed budget for the CIP, attached and incorporated, for the Fiscal Year commencing October 1, 2010 and ending September 30, 2011 is approved. Section 2. This Resolution shall be effective immediately upon its adoption and signature of the Chairperson. Mays Independent Counsel Submitted Into the r record in connecUot item 214 7 on 51- Pemr-iffiq A- Thr ...TITLE A RESOLUTION OF MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE TOTAL ANNUAL BUDGET FOR THE CIVILIAN INVESTIGATIVE PANEL, IN THE AMOUNT OF $464,000.00, FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2010 AND ENDING SEPTEMBER 30,2011, ..Body WHEREAS, the City of Miami Civilian Investigative Panel ("CIP") serves as an independent citizens' oversight with authority to conduct investigations related to allegations of police misconduct, review policies of the Department of Police and is empowered to issue subpoenas for police misconduct investigations; and WHEREAS, Section 11.5-10 of Code of the City of Miami, Florida, as amended, requires that a budget pertaining to the management, operations, maintenance and capital expenditures for the CIP, be approved by the City Commission; and WHEREAS, the CIP submits the attached budget request in the amount of $464,000.00, to conduct the primary functions of the CIP for Fiscal Year commencing October 1, 2010 and ending September 30, 2011; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated as if fully set forth in this Section. Section 2. The proposed budget for the CIP, attached and incorporated, for the Fiscal Year commencing October 1, 2010 and ending September 30, 2011, is approved. Section 3. This Resolution shall be effective immediately upon its adoption and signature of the Mayor. {1} Julie O. ThOMPM City Cksk Footnote: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
